Sun Grove Resort Village (SGRV) is a senior living facility located at 10134 W. Mohawk Ln., Peoria, AZ 85382. SGRV was built 30 years ago. SGRV consists of 11 buildings which house 86 separate apartments and a main club house. SGRV was one of the 23 senior living facilities destroyed by the AREI/Oakdale Heights Ponzi Scheme. The mastermind, James Koenig, was sentenced to 43-years in jail for defrauding 2,000 investors of $250 million and destroying 23 senior living facilities. The judge said it was the elder abuse of nearly 2,500 elderly in all the damaged senior living facilities caused by James Koenig was the reason for his long prison sentence.
The SGRV property has many problems because it has been poorly maintained for ten years due to cash flow limitations. The SGRV property has the following dangerous living conditions:
1. Bad electrical wiring and apartment fires.
2. Obstructed and uneven walkways causing injuries.
3. Fire danger citations for broken elevator phones.
4. Mosquito infestations in moldy fountains (pictured).
5. Extensive cockroach problems putting the elderly at risk.
6. Documented toxic mold cause by leaky pipes in the apartment walls.
7. Poor swimming pool maintenance resulting in many closings.
8. Restaurant closed due to raw sewage in the kitchen and dining room.
9. Recent toxic mold found in men’s room in the club house (pictured).
10. Wires and electrical boxes dangling off the outside walls not properly secured.
This has been documented by Maricopa County Environmental Services, Pro-Lab/SSPTM, Inc., recorded testimonies by a private detective, and notarized/written statements.
SGRV went bankrupt in 2014 and was acquired by Fannie Mae. Hoazilla LLC purchased the distressed property in a 2015 auction. Hoazilla LLC has hired the management company Tarantino Properties. Presently, SGRV is undergoing a massive remodeling and will soon open under the new name of THE FOUNTAINS AT LAKE PLEASANT.
Sadly. it appears that the SGRV remodel is simply a cosmetic fix and it is not addressing the dangerous safety and health dangers. In talking to the SGRV workers they say they are unlicensed. We see no building permits issued by Peoria like was done to repair the recent apartment fire. We have asked the Peoria Building Maintenance and Permit Department to oversee this project that it is done right to protect the future elderly residents.
My wife and I were residents of SGRV in 2009 and she is very sick from the rejection of her transplanted liver caused by her exposure to toxic black mold in her #1027 SGRV apartment. We saw many injuries and a death caused by the uneven walkways. We had relatives get sick from the SGRV dirty pool. We saw two apartment fires at SGRV. We saw a senior trapped in her apartment for several days after an injury because her alarm system was broken. We even saw the SGRV elevator kill a resident’s dog because it did not close properly.
We wish SGRV (The Fountains at Lake Pleasant) well but we want to insure that the dangerous property conditions for the elderly.

FAIR HOUSING LAWS ARE NOT ENFORCED IN ARIZONA

FAIR HOUSING DISCRIMINATION IS THE VIOLATION OF YOUR CIVIL RIGHTS
April 2016

April in National Fair Housing Month. Fair Housing violations is the most unreported civil rights problem because only 1% of the millions of violations are reported every year. This report is about how fair housing rights are not enforced in Arizona.


We just blocked a lawsuit against us from Hoazilla LLC. That company is the new owner of our former senior living facility, Sun Grove Resort Village (SGRV). Hoazilla attempted to foreclose on home with an old illegal lien. We lost the 2009 & 2010 SGRV lawsuits filed against both Carol and me. 

Our fair housing rights were violated at SGRV and we moved because our health was in danger but Arizona law favors the slumlord. Our previous slumlord's new lawsuit has resulted in the reopening of the possibly of the recovering our losses from SGRV. It has given us the ability to report the new charges of the violation of the Federal Debt Collection Protect Act (FDCPA) by SGRV's attorneys. This new bogus lawsuit opened has a six-year Statute of Limitations which allows us to reach back to the 08/16/2010 SGRV law breaking activity and sue SGRV and its attorneys.



Arizona law does not allow the renter the ability to protect themselves from dangerous life threatening slumlords. We spoke at the Arizona Capital on 02/14/2011 but our pleas for help for protecting renters were ignored by our state lawmakers. 

We now have filed Consumer Financial Protection Bureau complaints with the feds. We are also meeting with an attorney to represent us in Federal Court in our possible future lawsuits. We have to deal with the feds to get justice because Arizona politicians and elected officials have a close relationship with their elections attorney and SGRV's former attorney, Scott E. Williams.

We saw many fair housing violations at SGRV and we will detail the SGRV law breaking activities. Possibly now the press will report about this SGRV because Hoazilla is reopening the mold filed dangerous senior living property under a different name. This was SGRV's last chance to bury us and take our home with the hope of getting us to remove negative internet postings about SGRV. They lost! Our internet postings will resume to warn the public about this dangerous facility which should be destroyed to protect the public!

WE JUST FILED TWO COMPLAINTS TO THE CONSUMER FINANCIAL PROTECTION BUREAU (CFPB)
Our complaints were filed with the CFPB concerning a slumlord and its attorneys.
April in NATIONAL FAIR HOUSING MONTH. HUD and Arizona Law Enforcement is a failure in protecting the consumers from slumlords.
HUD is America's biggest slumlord.

HUD IS BROKEN
HUD prosecutes 300 fair housing complaints out of 30,000 filed a year.
Our fair housing complaint #09-11-0405-8 was closed by the retiring HUD administrator, Chuck Hauptman (pictured), before his investigator, Catherine Ross-Perry, had finished gathering our documentation. That was not Justice!

SUN GROVE RESORT VILLAGE'S (SGRV) 
FAIR HOUSING VIOLATION #1: 

LANDLORD CANNOT DISCRIMINATE AGAINST YOU FOR FIGHTING FOR YOUR FAIR HOUSING RIGHTS

It is illegal for a landlord to retaliate due to being involved in protecting yours and/or others fair housing rights.

However, SGRV did just that with the below 08/25/2009 letter kicking my 93-year old aunt Catherine Reinertson (pictured below) out of SGRV apartment #1017. This was landlord retaliation because I was the chairman of the resident's committee and fought for the residents' fair housing rights.

This illegal landlord retaliation was verified by our Private Detective, Jacob Mueller (pictured). His 07/29/2011 report stated: "Mr. Bakke (Reinertson's executor and nephew) told me that Cathryn Reinertson moved from Sun Grove because she was told she could no longer live there. Mr. Bakke had spoken with Mr. Green about that fact. Mr. Green informed him that Sun Grove had an issue with Mark Fairall, who was living in the same apartment as Catherine Reinertson. During that conversation, Mr. Green did not feel that it was in Sun Grove's best interest to allow Catherine Reinertson to continue living at Sun Grove." SGRV then sued my aunt when she moved early because the slumlord refused to repair her air conditioning unit. Catherine Reinertson paid SGRV the $3,000 extortion lawsuit (CV2009-732227).

This 08/25/2009 letter from SGRV's management company, Seniority, Inc., forced her to move from her SGRV apartment. This non-renewal of Ms. Reinertson's lease came after I had informed SGRV on 08/06/2009 that I was moving from SGRV. The slumlord's attorney, Scott E. Williams, filed a baseless lawsuit and threatened her with jail. Catherine Reinertson paid the SGRV $3,000 extortion. She died shortly afterwards afraid and a broken elderly woman.

MELANIE DEFOREST
A Fair Housing Complaint (#CIC09-22266) was filed on 09/21/2009 with the Arizona Attorney General Terry Goddard. Mr. Goddard denied the complaint stating he could not represent one consumer. A police report (#1-10-007447) was filed with the Peoria Police. Detective Howard told us that the Peoria police did not have the manpower or interest to worry about the SGRV elder abuse. Judge Melanie Deforest (pictured) refused to allow this evidence in our trial (#CC2010-038658) to recover my illegally collected $650 fee for a licensed service dog paid to SGRV.

All state and federal officials ignored the private detective's report documenting SGRV's criminal activities.

FAIR HOUSING RIGHT VIOLATION #2:

IGNORED AND REFUSED REASONABLE ACCOMMODATION REQUESTS FROM A DISABLED PERSON

Carol Fairall (Buck) is a post-liver transplant patient and has to take anti-rejection medication. SGRV's former manager, Scott Green, stopped the delivery of that medication to SGRV. Two emails were written by us and our attorney but they were ignored by Green and refused by his shyster attorney, Scott E. Williams. This was simply illegal landlord retaliation for her relationship with me because I fought for the SGRV's residents fair housing rights.

Our 09/29/2009 email to Scott Green stated: "Your recent refusal to accept packages at the office for Carol or myself is also Harassment as you did today by refusing to accept a package for Carol. She was lucky the FedEx man brought her delivery to her apartment since it was critical medication. You need to accept packages for us the same as you do other Sun Grove Residents." SGRV ignored that request from a disabled person which put Carol's life in danger.

Our attorney's, Mark Tucker, 10/09/2009 email to SGRV's attorney Scott E. Williams stated: "Please instruct Scott Green and the staff at Sun Groves that they are not to interfere or interrupt the delivery of Ms. Buck's medication. Her life depends on it." Scott E. Williams denied the request stating that SGRV stopped all deliveries. That was a lie confirmed by our private investigator. The only other person that had the delivery of his medication stopped was Dan Monroe. This was SGRV retaliation because Mr. Monroe also fought for the SGRV's residents fair housing rights. Mr. Monroe's testimony was recorded and documented before he passed away by private investigator Jacob Mueller

The recent lawsuit against us by SGRV used the judgment against Carol
where this critical evidence was dismissed by the incompetent judge, Melanie Deforest. The judgment was wrong because in fact Carol "Had The Right To Move" according to case law DiCenso v. Cisneros 96 F3d 104 (7th Cir 1996). SGRV was a hostile environment that put her life in danger with the refusal of the reasonable accommodation request by a disabled person. We are now heavily documenting for the feds the fair housing crimes at SGRV. SGRV opened our Federal Debt Collection Protection Act violation recourse with its recent bogus lawsuit where they attempted to foreclose on our home.


ARIZONA ORGAN TRANSPLANT INFORMATION
This is written to answer some questions from our Facebook friends all over the world about Carol (pictured) and her liver transplant. Carol had her liver transplant on 10/30/2007 at Banner Good Samaritan Hospital in Phoenix. The cause of her liver failure was not alcoholism but the cause were never determined. Carol started rejecting her transplanted liver when she was exposed to the SGRV toxic mold in September 2009.

Carol has been a transplant mentor to Good Samaritan Hospital for years helping patients prepare for the transplant procedure. Arizona is one of the most difficult states to get an organ transplant because of the lack of organ donors. Carol actively raises funds for the American Liver Foundation.
Only about 2% on the organ transplant on Arizona's waiting list get their needed lifesaving organ transplant.
NOTE: It was shocking that SGRV's Medicare fraud felon (almost 2,700 false Medicare bills) former manager, Scott Green (pictured), stopped the delivery of Carol's medication. See:

It is more shocking that SGRV's shyster "evictions king - 100,000 evictions in 20 years" lawyer, Scott E. Williams (pictured), denied Carol's attorney's reasonable accommodations request from a disabled person to allow the continuation of her medication delivery. Her life depended on it and SGRV did not care which forced Carol to move to save her life. The shyster attorney sued her twice for the same rent debt and greatly exceeded Justice Court lawsuit limitations. Arizona officials ignored this travesty of justice while court records disappeared.

It is even more shocking the new SGRV owner, Hoazilla LLC, and the new management company, Tarantino Properties, would approve the bogus new lawsuit. This was done with malice and intent to make Carol, who is very sick, homeless without asking us if we owed the debt. This was illegal! This is Slumlord Retaliation and Greed!

SGRV'S new management company, Tarantino Properties, Inc., is a Texas based senior living management company.


The senior living facility's advertising is looking for an executive director for the old SGRV. The Tarantino Properties advertising states that the senior living property is currently undergoing a large renovation. Our research of Tarantino Properties shows a shocking number of complaints on the internet and on YELP about the company. The complaints report this management company scams renters with high prices and provides terrible services in dangerous properties. The people posting complaints on YELP recommend that you stay away from Tarantino, Properties. The reviews of former employee of this company report a complete lack of ethics and only its is only concerned is about making as much money as possible. See YELP reviews:



The elder abuse and fraud continues at SGRV but just with a new slumlord. The dangerous 86-unit SGRV was built over 30-years ago and was poorly maintained and is full of mold. SGRV (The Fountains at Lake Pleasant) needs to be destroyed to protect the public.

FAIR HOUSING RIGHT VIOLATION #3:

FAILURE TO PROVIDE SAME SERVICES TO EVERY TENANT

According to our Pro-Lab SSPTM Inc. 10/18/2009 report, SGRV has Bioplaris mold (Stachybotrys) which is a fungus that damages the liver and kidneys. SGRV also has Dreschlera which are spores that cause eye infections. These molds are caused by leaky pipes in the walls. SGRV's toxic mold is the killer BLACK MOLD (pictured).

SGRV's attorney, Scott E. Williams, hired Environmental Consulting, Inc (ECI) on 10/16/2009. ECI was a small firm run by Miranda Mayo working out of his home with one inspector, Brandon White. ECI used the mold lab Tierra Science but that lab was closed due to inaccurate tests. Brandon White found no mold at SGRV and charged SGRV nothing for the test (see bill below).

It was understandable why Mr. White found no mold at SGRV because ECI filed for bankruptcy and closed its doors. SGRV's attorney, Scott E. Williams, hired Brandon White (pictured) for his Association of Landlord Tenant Attorneys (ALTA) as a consultant. The SGRV mold test was a total scam. 

The senior housing facility is full toxic mold. Mold was just discovered in the SGRV's men's room in the club house (pictured).

Carol had three water leaks in her SGRV #1027 apartment (pictured). SGRV failed to fix the problems and refused to remove the wall to fix the leaky pipes. SGRV allows renters to use the extra apartment reserved for such problems. Carol was denied that service because of her relationship to me fighting for fair housing rights. That was a violation of Fair Housing Right Laws by discriminating with providing different services to different renters.
WATER LEAK AND TOXIC MOLD IN CAROL'S SGRV #1027 APARTMENT
SGRV violated ARS 33-1324 by failing to maintain a fit premise and failing to provide a safe and healthy environment. This was a violation of ARS 33-1361 Noncompliance of a Landlord and ARS 33-1321 Failure of Landlord to Meet Obligations. Carol was forced to move because the SGRV mold exposure started the rejection of her transplanted liver. SGRV sue her twice for breaking her lease. SGRV won over $20,000 in judgments for a disputed $4,200 SGRV rent bill. This was not justice but it was just the misusing of the legal system for slumlord harassment.

SGRV went bankrupt in 2013 and Fannie Mae repossessed the 86-unit senior housing facility. SGRV was sold in 2015 in an auction by Fannie Mae to the new owners, Hoazilla LLC. Hoazilla has hired the management company Tarantino Properties. Both Hoazilla and Tarantino focus on buying and running distressed properties for huge profits.

The bottom-line is the fact that SGRV (soon to be named: THE FOUNTAINS AT LAKE PLEASANT) is a dangerous facility full of toxic mold, bad wiring, and dilapidated buildings. It is just another slumlord scamming the elderly in a dangerous housing facility that should be destroyed. It is amazing how shyster lawyers help the crooks in Arizona.
The solution is to have real tenant protection laws in Arizona. That will not happen because Scott E. Williams wrote the Arizona Landlord/Tenant Act and represents Arizona officials in election matters.

 DEPOSIT CHARGED FOR A SERVICE DOG
I had a seizure trained service dog, Wheeler (pictured), that could push the alarm when I had a seizure to call for help.
WHEELER'S SERVICE DOG LICENSE 

SGRV illegally charged a pet fee deposit of $650 for my service dog. The former SGRV manager, Scott Green, refused to refund the illegally collected pet fee requested in letters to him.


Wheeler was a Sheltie show dog that was highly trained to be a service dog. His show name was "Wheel of Fortune" .and he won many awards in national shows. He wore his service dog vest all the time. His service dog documentation was not allowed in our Justice Court 07/2010 trial by judge Melanie Deforest when I sued to recover the illegally collected $650 charged pet fees. Scott Green lied when he stated that he had no memory about my service dog fee dispute.



BRIDGET & BRITTANY
After we moved from SGRV, Wheeler who was only 11-years old became deathly sick from his exposure to the SGRV toxic mold died of liver cancer. He was very healthy before SGRV. In fact, Carol's two Yorkies, Bridget and Brittany (pictured), shortly passed away due to their SGRV toxic mold exposure due to liver cancer. The SGRV toxic mold caused Carol's transplanted liver to start rejecting and now she is near death.

I filed a HUD complaint but it was denied because SGRV had been approved as a HUD low income property. We asked for help from Senator John McCain and he told us to hire a lawyer. It has been very disappointing how SGRV was able to violate our Fair Housing Rights with no law enforcement to stop the crimes.

I reviewed SGRV's present reconstruction today. I found that it was simply cosmetic improvements done by unlicensed contractors. No work was being done to remove the toxic mold in the walls from the leaky pipes. SGRV will soon reopen as THE FOUNTAINS AT LAKE PLEASANT.

How many more lives will this dangerous senior living facility claim with the toxic mold?

List of 66 Abused Elderly from Sun Grove Resort Village (40 Have DIED with NO Justice)

SUN GROVE RESORT VILLAGE (SGRV)

ABUSED SENIORS


My wife, Carol, and I are elder abuse victims and senior financial exploitation victims of Sun Grove Resort Village (SGRV) which is located at: 10134 W. Mohawk Lane, Peoria, AZ 85382. We lived at SGRV from October 2007 to October 2009.




SGRV was one of the 23 senior living facilities which were involved with the largest California Ponzi Scheme, AREI/OAKDALE HEIGHTS, which stole $250 million from 2,000 investors. The Master Mind of the Ponzi Scheme, James Koenig, received a 43 year prison sentence based upon our documentation of the elder abuse that over 2,500 seniors suffered.  




SGRV is a senior living facility which was run by a 2005 Medicare Fraud Felon, Scott Green, for nearly eight years until August 28, 2012, when he was terminated by the 20 Investors/Owners for suspected embezzlement. Scott Green was picked up by the feds for Parole Violations and sent back to prison in Boston.




SGRV went bankrupt and was recently sold for half the value (approx. $2.5 million) to HOAZILLA, LLC . It is reported that SGRV's 88 units, restaurant, and club house is being remodeled. It is reported that HOAZILLA, LLC is changing SGRV's name. 




We will never forget the abused and defrauded elderly SGRV residents that did not received any justice, 
they are:

1. Elliot Alberts
2. Rosemary Alberts 
Mrs. and Mrs. Alberts were victims of SGRV's false advertising and exploitation. Once the Alberts discovered that SGRV was an Impostor Assisted Living Facility with an Impostor Nurse they moved. SGRV filed a Baseless Lawsuit and was awarded a wrongful judgment against the Alberts for $10,502.00.

3. Laura Lee Boyd (Deceased) 
Ms. Boyd was a victim of SGRV's false advertising and exploitation. Ms. Boyd was confined to her scooter because she was unable to walk. She moved to SGRV for the promised medical care and the availability of a nurse. Her condition worsened and she was unable to transfer and SGRV failed to provide her the promised needed medical services. Ms. Boyd discovered that Claudia Marquez was not a licensed nurse and that she was unable to care for Ms. Boyd's medical needs. Ms. Boyd needed to move to a licensed assisted living facility. SGRV's manager forced Ms. Boyd to leave her sit-down tub which she installed at SGRV without any remuneration and forced to pay $6,000 to break her lease early. Ms. Boyd wrote in her notarized affidavit that she was defrauded by SGRV.




4. Tess Burges (Deceased)

Mrs. Burges was a victim of SGRV's Fair Housing Violations for fighting for the rights of the other SGRV Residents. Mrs. Burges was a member of the Ambassadors' Group which was an elected group of SGRV seniors that presented problems to SGRV management. SGRV's Scott Green retaliated and raised her apartment rent an extra several hundred dollars because she fought for the other SGRV Residents' Fair Housing Rights. Mrs. Burges was forced to move and leave her apartment upgrades without any remuneration because of the SGRV Retaliation.

Mr. Burges suffered the loss of his wife who died shortly after her SGRV elder abuse and financial exploitation. The Burges' were forced to move to Desert Winds Senior Living Facility, which is across the street from SGRV.





6.  Sally Byers (Deceased)
Ms. Byers was a victim of SGRV's Fair Housing Violations for filing a formal complaint with the Arizona Attorney General because her rights were violated.  SGRV's Scott Green banned Ms. Byers and Ms. Toedebusch from playing Bridge anywhere on the SGRV property because they would not allow a fifth player to play in a Bridge game. The card game Bridge cannot be played with five players. Ms. Byers was banned from the SGRV Club House and the Patio Area from playing Bridge and was threatened the discipline of a fine if she continued to play Bridge at SGRV. The Arizona Attorney General told Ms. Byers and Ms. Toedebusch to hire a lawyer and did nothing to protect their Fair Housing Rights of Equal Access to the SGRV property and activities.

Rev. Confair was a victim of SGRV's false advertising that SGRV had a working medical alarm system. Rev. Confair was confined to a scooter and often fell down. He suffered many times when he pulled the intercom cord for help when he had fallen. His wife would come home and find Rev. Confair on the ground because SGRV personnel never responded to his intercom signals for help. Mrs. Confair suffered from the loss of her husband because it is suspected that this SGRV elder abuse hastened Rev. Confair's death. Mrs. Confair reported that SGRV’s Scott Green also stole money from her for paying excessive extra second residents fees after the death her husband.





9.  Debra Conroy
Ms. Conroy was a victim of SGRV's advertising and Baseless Lawsuits. Ms. Conroy discovered that SGRV did not have the promised medical services and moved. She faced the threat of a Baseless Lawsuit and was defrauded into paying a Lease-Breaking Fee.

10. Rose Costello (Deceased)
Ms. Costello was a victim of SGRV's poor living conditions.  Ms. Costello was appalled at the cockroach infestation at SGRV and moved out.

Mr. Crabtree and Ms. Duffy lived together at SGRV and they were victims of SGRV's false advertising that SGRV was a licensed assisted living facility with a nurse. They both spent additional time in the hospital because SGRV was unable to care for their medical needs.



13. Eldon Doll
Mr. Doll was a victim of the theft of $25,000 by the SGRV caregiver, Gail Magnuson. SGRV's manger, Scott Green, threatened Mr. Doll with eviction if he reported the crime to the police. Mr. Doll lived in fear of being evicted and did not report the crime to the police.


14. Cliff Dyrland (Deceased)
Mr. Dyrland was a victim of SGRV's Fair Housing Rights Violations. Mr. Dyrland was retaliated against by SGRV's manager, Scott Green, because he was a member of the SGRV Ambassadors' Group that fought for the Fair Housing Rights of the other SGRV Residents. Mr. Dyrland was charged an extra $1,000 a month for rent because he helped protect the other SGRV Residents.

Mr. Dyrland was our main witness that would have verified SGRV's illegal landlord retaliation in the Fairall v. SGRV Trial. However, he failed to appear in court because he was in a coma from an automobile accident. The Arrowhead Justice Court's former Judge Melanie Deforest, who was forced off the Bench because she lied about her education, refused to delay the trial which violated our Fair Trial Rights.





15. Lil Eggen (Deceased)
Mrs. Eggen was a victim of SGRV's false advertising, impostor nurse mistakes, and toxic mold. Mrs. Eggen was a nurse and was shocked to learn that Claudia Marquez was an impostor nurse at SGRV who used poorly trained caregivers. Mrs. Eggen had an operation on her leg which confined her to a wheel chair. The SGRV caregiver rammed her leg into the wall which caused more pain and damage. SGRV's manager, Scott Green, refused to refund the $500 refundable deposit fee and threatened Mrs. Eggen with an erroneous carpet damage fee when she moved to Desert Winds Senior Living. Jacob Mueller, our Private Investigator, documented the elder abuse and fraud Mrs. Eggen suffered at SGRV by interviewing her son John Eggen. Mrs. Eggen lived in fear of SGRV's manager Scott Green until the day she died. John Eggen stated in his recorded interview that his mother's SGRV apartment had mold.





16. Paul Elias
Mr. Elias was a victim of SGRV's false advertising and baseless lawsuits. Once Mr. Elias discovered that SGRV was an Impostor Assisted Living Facility with an Impostor nurse, he moved. SGRV filed a Baseless Lawsuit against Mr. Elias which was settled out of court.

17. Gladys Elkins (Deceased)
Ms. Elkins was a victim of SGRV's false advertising and was threatened with a Baseless Lawsuit when she moved to obtain the medical assistance she needed. Ms. Elkins paid the extorted Breaking-Lease Fee.

18. Mark Fairall
19. Carol Ann Fairall (nee Buck)
The Fairalls were victims of SGRV's false advertising, landlord retaliation, and Baseless Lawsuits. Carol Fairall was first sued for breaking her lease when she moved because SGRV refused to fix a toxic mold problem and SGRV stopped the delivery acceptance of her medications. SGRV received a wrongful Default Judgment for that lawsuit of $2,568.36. Mark Fairall sued SGRV for $9,999.99 to recover illegally-charged service dog fees, to recover lost apartment upgrade costs, to cover the costs of a stolen countertop, and the penalty allowed by law for not maintaining a safe and healthy place in which to live. Mark Fairall lost that lawsuit because his evidence was wrongfully dismissed, his witness was in a coma, and proper Trial Procedures were not followed.

SGRV counter-sued the Fairalls for breaking their lease early and Interference of a Contractual Relationship. SGRV was awarded a wrongful Judgment of $20,667.99. This was double satisfaction of a debt which exceeded Justice Court Limitation of $9,999.99.The total SGRV wrongful judgments against the Fairalls' is $23,236.35. The exposure to the SGRV toxic mold killed the Fairalls' three dogs (liver cancer) and started the rejection of Carol's transplanted liver (he blood work shows rejection numbers 14 times higher than normal).


SGRV's Scott Green hired their lawyer, Scott E. Williams, to represent their SGRV employee and Mark Fairall's renter, George Kieffer, against Fairall's rental house eviction for nonpayment of rent. Scott E. Williams and Mark Tucker, Fairall’s former attorney, signed an Unauthorized Stipulation Agreement which waived all unpaid late rent in order to get Kieffer to move from the Fairall Rental. That wrongful agreement cost the Fairalls $9,999.99 in a recoverable lawsuit award. George Kieffer caused over $20,000 in damages to the Fairall Rental Home and wired it to burn down. George Kieffer threatened to kill Mark and Carol Fairall and stalked them at SGRV. The Fairalls obtained an Injunction against Harassment, but SGRV's Scott Green ignored the court order and gave Kieffer a key to their apartment. SGRV's attorney, Scott E. Williams, and Judge Melanie Deforest blocked their cross-examination of Kieffer which robbed the Fairalls of a Fair Trial. This was all done in Landlord Retaliation because the Fairalls fought for their and other SGRV Resident’s Fair Housing Rights. Mark Fairall served on the SGRV Ambassador Group but had to resign early because Scott Green became upset when he addressed the health issues caused by SGRV renting to seniors with highly contagious diseases such as MRSA and TB.

The Arrowhead Justice Court fully supported the SGRV Court-Sanctioned Senior Exploitation of the SGRV Felon Scott Green. All Fairall Appeals and a Fraud of the Court Motion have been denied. All the evidence and the recording of the Trial have been destroyed in the cover-up of SGRV attorney Scott E. Williams' misuse of the legal system. Eleven False Elder Care Referral Agency Contracts where SGRV's Scott Green purposely misrepresented SGRV as an Assisted Living Facility were turned over to the Arizona Attorney General for prosecution of false advertising on the internet. Nothing was done by Arizona Officials to stop SGRV's illegal activities. CHANNEL 3 ON YOUR SIDE aired the Fairalls' SGRV elder abuse, fraud, and toxic mold story.

It is interesting to note that all the SGRV criminal evidence have the attorney Scott E. Williams' "Bates Stamp" on them which is proof that the SGRV attorney is aware, condones, and supports SGRV's law- breaking activities. 
We have reported the SGRV false 11 internet advertising to the FBI, IC3, and Department of Justice.      



20. Stanley Fishman (Deceased)
Mr. Fishman was a victim of SGRV's false advertising and Fraud. Mr. Fishman became aware that SGRV is not a licensed assisted living facility. Mr. Fishman did a lot of handyman work for SGRV's Scott Green and was not paid for the work that he did at SGRV. Mr. Fishman sued SGRV to recover the monies due him.

We are very aware that SGRV does not pay their contractors or suppliers by the lawsuits against SGRV. Unfortunately, Mr. Fishman uses the court system a lot with lawsuits while trying to collect monies due him. Sadly, SGRV's lawyer Scott E. Williams has posted on his FACEBOOK for his firm legal documents filed by Mr. Fishman and calls him a "nut case." Scott E. Williams uses bullying and abusive name calling to demoralize his opposition. This is highly unethical by Scott E. Williams because he is an attorney and is held to a higher standard.

21. Pat Forst
Mr. Forst was a victim of SGRV's false advertising and a Baseless Lawsuit. Mr. Forst filed complaints with the fire department that many SGRV residents that could not walk and those who rode scooters were forced to live on the second floor. He was concerned that the SGRV elevators were often broken, and this was a health fire hazard. SGRV's Scott Green filed a Baseless Lawsuit against Mr. Forst in Retaliation when he moved because he was afraid for his life. Mr. Forst had to pay an extra Breaking-Lease Fee.

22. Lena Frei (Deceased)
Ms. Frei was a victim of SGRV's poor living conditions. Ms. Frei rode a scooter due to her inability to walk. Her scooter tipped over several times due to the uneven SGRV sidewalks which hastened her death.


23. Maxine Gordon (Deceased)
Ms. Gordon was a victim of SGRV' false advertising and poor living conditions. Ms. Gordon was forced to move when SGRV's Impostor Nurse was unable to provide the medical attention she needed.





24. George Grabach (Deceased)
25. Ruth Grabach
Mr. and Mrs. Grabach were victims of SGRV's false advertising, SGRV's inability to provide proper medical help, and having their Medical Privacy Rights violated. SGRV's Scott Green and Claudia Marquez impersonated a doctor and nurse to obtain confidential medical information from Mr. Grabach's temporary nursing home. SGRV's manager Scott Green wrote that Claudia Marquez was a nurse and that he did not have to follow the HIPAA Laws. SGRV continued to charge for a parking space after the Grabach’s had sold their truck and continued to charge the extra $425 second person rent fee after Mr. Grabach had passed away.


All this information was documented in Ms. Grabach's notarized affidavit with copies of all correspondence and documents received from SGRV's Scott Green and her letters of protest to SGRV's Scott Green. All this criminal evidence has been turned over to the Arizona Board of Nursing and the Arizona Attorney General, but nothing has been done. Claudia Marquez was warned on 05/25/05 to stop impersonating a nurse, but she continues to do so today which puts the SGRV Senior Residents at risk.





26. Ann Graham (Deceased)
Ms. Graham was a victim of SGRV's false advertising and Landlord Retaliation. Ms. Graham discovered that SGRV did not provide the advertised medical services and that the nurse was an Impostor. Ms. Graham immediately moved out but SGRV refused to refund her deposit and changed the locks on her SGRV apartment which prevented her from moving her things. Ms. Graham went to CHANNEL 3 ON YOUR SIDE. Channel 3 aired her story, and she was able to recover her things.





27. John Guidone
Mr. Guidone was a victim of SGRV's false advertising. He moved out after his one year's lease expired when he discovered that SGRV did not provide the promised medical care.

28. Helen Hanes (Deceased)
Ms. Hanes was a victim of SGRV's false advertising. She moved out when she discovered that SGRV did not provide the promised medical care.





29. Clay Haning (Deceased)
30. Pam Kline
Mr. Haning and Ms. Kline lived together at SGRV and they were victims of SGRV's Fraud and abuse. Mr. Haning prepaid his rent of over $18,000 for the upcoming year before an operation. Mr. Haning passed away and SGRV refused to refund the monies. Mr. Haning's daughter, Ms. Parrott, went to the Police but they did nothing so she went to CHANNEL 3 ON YOUR SIDE for help. Channel 3 helped her recover the $18,000.



Ms. Kline used a scooter because she could not walk. SGRV put her in a SGRV apartment on the second floor after Mr. Haning passed away. Ms. Kline’s dog, Buddy, was hung by SGRV's elevator because it did not properly reopen the door when Buddy jumped out of the elevator while he still was on his leash.




31. Catherine Hickok
Ms. Hickok was a victim of SGRV's false advertising. When Ms. Hickok discovered that SGRV was an Impostor Assisted Living Facility with and Impostor nurse, she moved. SGRV filed a baseless lawsuit, and 
SGRV was wrongfully awarded a $2,250.35 judgment.

Mr. and Mrs. Horner were victims of SGRV's false advertising and poor living conditions. They were outspoken critics of SGRV's Scott Green. Scott Green defamed their names, called them malcontents, and refused to renew their lease. The move broke Mr. Horner, and he passed away within a ye
ar of being evicted from SGRV.

34. Florence Howe (Deceased)
Ms. Howe was a victim of SGRV's false advertising when she required additional medical help.

36. Bonnie Hunt
Mr. and Mrs. Hunt were victims of SGRV's false advertising. Both of the Hunts served on the SGRV Ambassadors’ Group, and they were badly treated by SGRV's Scott Green because they fought for the SGRV Residents’ Fair Housing Rights. Scott Green retaliated

when Mr. Hunt passed away because Mrs. Hunt lost her husband's pension and could no longer live at SGRV. Mrs. Hunt had to sell her wedding ring in order to pay the SGRV Lease-Breaking Fee. After Mrs. Hunt left, she moved into a HUD low cost housing apartment. SGRV's Scott Green refused to refund the $400 refundable deposit. Mrs. Hunt sued SGRV and won a $400 judgment. However, she still talks about Scott Green stealing her wedding ring with his greed.




37. Catherine Keily
Ms. Keily was a victim of SGRV's false advertising that it had a medical alarm system. SGRV had an intercom system which rang in the SGRV manager's office. No one heard the intercom if the manager was not in the office. It was not a medical alarm system. Ms. Keily fell down in her SGRV apartment and terribly injured herself. She called for help for three days using the SGRV intercom system, but no one heard the intercom. No one from SGRV checked on her when she failed to come to dinner. Ms. Keily was near death when she was found. She was hospitalized for nearly a month. Ms. Keily moved from SGRV because she knew SGRV could not properly care for her. She also moved because she no longer could live in her SGRV apartment because of the bad memories.


38. Bill Klink (Deceased)
39. Dorothy Klink (Deceased)
Mr. and Mrs. Klink were victims of SGRV's false advertising and Fair Housing Discrimination. Both of the Klinks served on the SGRV Ambassadors’ Group and fought for their and other SGRV Residents’ Fair Housing Rights. Scott Green treated the Klinks so badly with nasty public comments and the withholding of essential services that forced them to move.

40. Vivian Knutson
Ms. Knutson was a victim of SGRV's false advertising and Fair Housing Discrimination. Ms. Knutson's daughter, DeDe Stockton, worked at the SGRV front desk. Ms. Stockton reported SGRV's manager Scott Green's illegal activities to his supervisor Chuck Major, Vice President of Seniority, Inc., a subsidiary of the American Baptist Homes of the West (ABHOW aka THE BAPTIST FOUNDATION). 

Ms. Stockton was immediately fired as a whistle blower. Ms. Knutson had to move because SGRV's Scott Green started withholding essential services. Scott Green was hired by Seniority. Inc. to manage SGRV in May, 2008. Seniority, Inc. failed to perform a background check which would have discovered that Scott Green was a 2005 Medicare Fraud Felon that made his living scamming seniors since 1999. Ms. Stockton has provided documentation of SGRV’s Scott Green's illegal activities of elder abuse, fraud, and information that SGRV is full of toxic mold.

41. Vi Lupon (Deceased)
Ms. Lupon was a victim of SGRV's fraudulent activities. She moved to Oregon to be closer to her family, but SGRV's Scott Green refused to refund her $1,200 Refundable Deposit Fees. In fact, Scott Green tried to charge for a chipped sink that was not chipped at the time of Ms. Lupon's move. This was a common practice of Scott Green to pad the bill at checkout for unsubstantiated damages.


42. Frank Matarrese (Deceased)
43. Nancy Matarrese (Deceased)
Mr. and Mrs. Matarrese were victims of SGRV's false advertising when they discovered SGRV could not handle their medical needs. Mr. Matarrese had TB and Mrs. Matarrese had a kidney rejection problem.  The both spent extra time in hospitals and nursing homes because their medical needs were not met by SGRV's Impostor nurse, Claudia Marquez.





44. Hazel Mathis (Deceased) 
Ms. Mathis was a victim of SGRV's false advertising when she discovered SGRV could not handle her medical needs. She was forced to move to a licensed assisted living facility.





45. Alfred Earl McHenry (Deceased)
Mr. McHenry was a victim of SGRV's poor living conditions. Mr. McHenry used a scooter because he could not walk. His scooter tipped over on a garden hose that went across the unevenly-paved sidewalk. Mr. McHenry was injured and he died a few days later.





46. Dan Monroe (Deceased)
Mr. Monroe was a victim of SGRV's false advertising, elder abuse, and Fair Housing Discrimination. Mr. Monroe was on the SGRV's Ambassador's Group and he fought for his and other SGRV Residents' Fair Housing Rights. SGRV's Scott Green stopped the delivery acceptance of Mr. Monroe's medications. SGRV's Impostor nurse, Claudia Marquez, refused to care for his open MRSA leg wounds. Mr. Monroe later had to have his MRSA diseased leg amputated. Mr. Monroe testified about all the SGRV illegal activities to our Private Investigator, Jacob Mueller, before he passed away.

47. Alberta Moore
Ms. Moore was a victim of SGRV's false advertising. When she discovered that SGRV was not a licensed assisted living facility, that SGRV's nurse was an impostor, and that SGRV did not have an emergency alarm system, she moved to protect herself. SGRV filed a Baseless Lawsuits a received a wrongful judgment of $5,882.75.

48. Betty Moore
Ms. Moore was a victim of SGRV's Fair Housing Discrimination. Ms. Moore served on the SGRV Ambassadors’ Group which protected the SGRV Residents’ Fair Housing Rights. Ms. Moore received huge rent increases in retaliation from SGRV's Scott Green who forced her to move.                                            


49. Imogene Olson (Deceased)
Ms. Olson was a victim of SGRV's false advertising. She discovered SGRV was not a licensed assisted living facility and that Claudia Marquez was not a nurse. She was forced to move to a licensed assisted living facility.

50. Clara Perry (Deceased)
Ms. Perry was a victim of SGRV's poor nursing care. Ms. Perry was totally incapacitated and needed 24/7 care, but SGRV caregivers often left her alone for hours. She passed away when she was alone.





51. John Pocarro (Deceased)
Mr. Pocarro was a victim of SGRV's false advertising. When he discovered SGRV was not a licensed assisted living facility and that Claudia Marquez was not a nurse, he moved to his daughter's home. Mr. Pocarro was very angry to pay Scott Green's Lease-Breaking Fees because he felt he had been scammed.

52. Roslyn Radden (Deceased)
Ms. Radden was a victim of SGRV’s false advertising of medical services provided by a licensed nurse. Ms. Radden had many medical problems but once she discovered Claudia Marquez was not a licensed nurse she cancelled Ms. Marquez and the SunSet Caregiver services. Ms. Radden’s death was hastened by SGRV’s lack of advertised medical services.




53. Catherine Reinertson (Deceased)
Ms. Reinertson was a victim of SGRV's false advertising, Fair Housing Discrimination, and a Baseless Lawsuit. Ms. Reinertson was retaliated against by SGRV's Scott Green because she was related to Mark Fairall (her nephew and roommate). SGRV refused to renew her lease, refused to fix her air conditioning unit, and filed a Baseless Lawsuit against her. SGRV extorted $3,000 from her, threatened her with jail, and forced her to
move from her apartment which had $3,000 worth of apartment upgrades. Ms. Reinertson died a year later, a broken women.





Our Private Investigator, Jacob Mueller, took Gil Bakke's testimony since Mrs. Reinertson had died. Mr. Bakke was Ms. Reinertson's Executor, and he flew in from Wisconsin to have several direct talks with SGRV's Scott Green. Scott Green and SGRV's attorney, Scott E. Williams, threatened Mr. Bakke with an Interference of a Contractual Obligation Lawsuit because he was looking after his aunt's well-being. Lawsuit threats were constantly used by the SGRV Felon Manager Scott Green and Attorney Scott E. Williams to bully people.

54. Marilyn Ricketts (Deceased)

Ms. Ricketts was a victim of SGRV's false advertising and Baseless Lawsuit. When she discovered SGRV was not a licensed assisted living facility and that Claudia Marquez was not a nurse, she moved. SGRV filed a Baseless Lawsuit and SGRV was awarded a wrongful judgment of $2,359.45.


55. Phyllis Risch (Deceased)
Ms. Risch was a victim of SGRV's false advertising, poor living conditions, and poor medical help. Ms. Risch paid for 24/7 care, but she was often left alone. She tipped over her scooter several times on the uneven SGRV sidewalks and nearly died. She often complained that the SGRV nurse failed to give her medication on time or even doubled up her dosages, which caused her to lapse into a coma. This was shocking because Claudia Marquez is not a nurse and it was illegal for her to store and administer medication. Ms. Marquez continues these illegal activity’s today even after complaints have been filed with the Peoria Police, Arizona Department of Nursing, and Arizona Attorney General.

56. Anne Rivano
Ms. Rivano was a victim of SGRV's false advertising, poor medical care, and fraud. Ms. Rivano's health worsened and SGRV could not give her the care she needed. She moved to a licensed assisted living facility. SGRV's Scott Green tried to collect thousands of dollars in damages from her to replace her carpet.

57. Alice Schoenfeld (Deceased)
Ms. Schoenfeld was a victim of SGRV's false advertising. She was very concerned when she discovered that SGRV was not a licensed assisted living facility and that Claudia Marquez was not a nurse.

58. Norma Schneider
Ms. Schneider was a victim of SGRV's false advertising. She moved when she discovered SGRV was not a licensed assisted living facility with a licensed nurse. She paid the Lease-Breaking Fee under protest. Ms. Schneider is presently living at Montecito Assisted Living and is getting the medical care she needs.

59.  Dr. H. Wayne Springfield (Deceased)
Dr. Springfield a victim of SGRV’s false advertising and Fair Housing Discrimination. Dr. Springfield discovered that SGRV was not a properly licensed assisted living facility and that the Impostor Nurse, Claudia Marquez, could not provide the medical care promised. Dr. Springfield was forced to often use the hospital because of his medical needs.

Dr. Springfield was a famous ecologist and author but he was forced to hide his identity when he lived at SGRV. Dr. Springfield feared SGRV’s Scott Green raising his rent an extra $1,000 a month, which was common practice. SGRV practice Housing Discrimination of Rent Rates based upon a renter’s net worth. Dr. Springfield did not want SGRV to steal from him because he left his multi-million dollar fortune to six universities for Ecology Scholarships. 




60. Jerry Stout (Deceased) 
61. Phyllis Stout
Mr. and Mrs. Stout were victims of SGRV fraud because of huge rent increases. Mrs. Stout had to move after her husband died due to the huge increase of her SGRV rent. Mrs. Stout had to leave her thousands of dollars of upgrades for which she received no remuneration. This was a common practice of Scott Green to push out a senior from their apartment and keep the upgrades for a higher rental fee to be paid by the next renter.





62. Vaughn Stout
Mr. Stout presently lives at SGRV and is concerned about the smell and the fact that he has been sick since he moved there. I met him in April of this year when I took the picture of the moldy fountain in front of SGRV. Mr. Stout informed me that SGRV stole his painting and has it hanging in the SGRV lobby. Mr. Stout asked and received a copy of our 82-page report called THE SUN GROVE RESORT VILLAGE ELDER ABUSE STORY that we sent to the US Senate and posted online per their request.

We are very aware that Mr. Stout is now writing flowery articles about SGRV online. In the past SGRV used the trick to reduce the rent for favors. SGRV used rental rates as a Rental Discrimination Tool to either reward or punish SGRV renters. It appears nothing has changed at SGRV after Scott Green's termination.

63. Joel Ticker
Mr. Ticker was a victim of SGRV's false advertising. When Mr. Ticker discovered that SGRV was not a licensed assisted living facility, he was sued with a SGRV Baseless Lawsuit. SGRV was wrongfully awarded a $2,568.36 judgment. The SGRV con was to give the new resident a free month's rent and when the senior moved out in one year, then SGRV would sue for that free month.

64. Millie Toedebusch
Ms. Toedebusch was a victim SGRV's false advertising, Fair Housing Violations, and a Baseless Lawsuit. Ms. Toedebusch filed a complaint with the Arizona Attorney General, Better Business Bureau, Adult Protective Services, and the Agency on Aging when she could no longer play Bridge in the SGRV property (See the Sally Byer story for details). Ms. Toedebusch was retaliated against by SGRV's manager Scott Green for her formal complaints with a Baseless Lawsuit. SGRV was awarded a $4,872.80 Default Judgment when her state- provided attorney, Tim Goddard, failed to appear at her Trial and failed to properly represent her. SGRV attached her savings account for the funds. Our Private Investigator, Jacob Mueller, took Ms. Toedebusch's deposition to document all of the elder abuse and senior fraud at SGRV.

65. Mae Westphal (Deceased)
Ms. Westphal was a victim of SGRV's false advertising and impostor nurse. She worried herself into the grave wondering if SGRV could properly care for her.



66. Juel Wilkerson (Deceased)
Mr. Wilkerson was a victim of SGRV's false advertising and broken medical promises. Mr. Wilkerson had TB but SGRV was not equipped to care for TB patients. In fact, Mr. Wilkerson put the other SGRV residents at a huge risk of catching TB. SGRV ignored the TB problem.
