IN MEMORY OF MILLIE TOEDEBUSCH WHO JUST PASSED AWAY ANOTHER FORGOTTEN ABUSED SENIOR

MILLIE TOEDEBUSCH
Millie Toedebusch was abused and defrauded at Sun Grove Resort Village (SGRV). She went to Arizona law enforcement and agencies for help but she was ignored. Ms. Toedebusch often cried how SGRV collected a wrongful $4,872.80 judgment twice. Ms. Toedebusch paid the monies but SGRV's lawyer, Scott E. Williams, also garnished her checking account. It took months to get the illegal garnishment monies returned.
Ms. Toedebusch complained about the following SGRV's problems to law enforcement:
1. False advertising,
2. Altered contract,
3. Personal verbal attacks from SGRV's former manager,
4. The withholding of essential services,
5. Fair housing rights violations for complaining to officials,
6. Fire dangers at SGRV,
7. Unsafe puddles of water on walkways,
8. Confusing agreements,
9. SGRV demanded the withdrawal of her complaints, and
10. A lawsuit that she lost when her attorney failed to  appear at her trial.


Ms. Toedebusch was 102-years-old at her passing. She authorized the release of our private investigator's, Jacob Mueller, report of his verification of the SGRV crimes and the lack of justice that she received. God bless you Ms. Toedebusch for fighting for yours and others civil rights. It is no wonder that only 1 out of 23 elder crimes are reported because NO ONE CARES. The below private investigators report went to and was ignored by the Peoria police and the Arizona Attorney General. Justice? NO! Ms. Toedebusch is number 49 of our 66 documented SGRV elder abuse cases who have passed away without any justice in the Arizona Badlands.

THE CRIMINALS THAT SCAMMED THE DECEASED MILLIE TOEDEBUSCH 
Ms. Toedebusch died on 09/25/2017 a SGRV scammed senior that lost $4,872.80. We posted our private investigator's 08/29/2011 report about the elder abuse and fraud that Millie Toedebusch suffered at SUN GROVE RESORT VILLAGE (SGRV). It took three crooked former SGRV employees (Green, Duncan, and Nunley) and the SGRV's shyster attorney (Scott E. Williams). This is where they are now:
Scott Green, former SGRV manger, is back in jail for parole violations of his 2005 felony conviction #105-cr-10166DPW in Boston. Green falsified 2,679 bills to Medicare for services he was paid but never did the work. Green and Duncan received an award in 2009 from the former management company of SGRV. Crime did not pay for Green. Carolyn Duncan, former SGRV sales manager, is back at the old SGRV which now has a new name and owners. Duncan altered the dates on Ms. Toedebusch’s SGRV contract and she did the same on Carol Fairall's SGRV's contract. Crime pays well for Duncan. Karl Nunley, former assistant manager at SGRV, has retired out of state. The SGRV problems resulted in his bankruptcy and divorce. Crime did not pay for Nunley. Scott E. Williams, SGRV's former attorney, is still an attorney. Williams has a huge law firm that specializes in evictions and elections law. Williams is protected because he brags that many Arizona politicians are grateful to him that they have their jobs. Crime pays very well for Williams.
It was eight years ago today on 10/23/2009 that Carol moved from SGRV. Carol also suffered slumlord retaliation for complaining to officials about SGRV like Ms. Toedebusch. Carol had the delivery of her medications stopped, refusal to resolve the mold problem in her SGRV apartment, and was sued twice for a disputed unpaid $2,000 rent that was later forgiven by SGRV's new owners Fannie Mae. SGRV refused to repair Mark's broken SGRV apartment's air conditioning unit which forced he and his aunt to move. Both Mark and his aunt, Catherine Reinertson, were sued on Christmas Eve in 2009. Mark was sued twice by Williams in retaliation for filing complaints about him and SGRV. Mrs. Reinertson was evicted and paid the $3,000 in the SGRV scam under threat of going to jail. We lost over $8,000 in SGRV apartment upgrades, deposits, and illegal service dog fees. Ms. Reinertson died shortly afterwards in fear and a broken woman from the SGRV scam.

MILLIE TOEDEBUSCH WAS TWICE DENIED HER DAY IN COURT
This week there is a memorial for the elder abuse victim, Millie Toedebusch. Ms. Toedebusch had her FAIR HOUSING RIGHTS violated by SUN GROVE RESORT VILLAGE (SGRV). Ms. Toedebusch had her essential services illegally withheld in SGRV's retaliation of her filing complaints with authorities. The silencing and failing to allow Ms. Toedebusch her day in court was done twice by Arizona Justice Court system. The Arizona Justice Court system is simply a rubber-stamp court which favors slumlords that uses non-lawyer judges who are often lacking in needed legal knowledge.
Ms. Toedebusch's first miscarriage of justice was when her Area Agency on Aging nonprofit organization's appointed lawyer, Tim Goddard (AG Goddard's brother), failed to appear at her trial concerning SGRV lawsuit for the nonpayment of rent. The second time Ms. Toedebusch had her legal rights to testify violated at our July 2010 justice court trial. Ms. Toedebusch was our witness in our lawsuit against SGRV in attempt to recover lost $5,000+ in apartment upgrades caused by SGRV's retaliation eviction and the recovery of the illegally collected $450 service dog fees. Mr. Toedebusch was thrown out of court by the judge, Melanie Deforest, because she whispered to her driver that she could not hear.
Judge Deforest was an incompetent justice court judge. Deforest was appointed as a political favor, had no formal education as she reported, and failed to complete required judge legal classes. Deforest threw out our evidence, refused to delay the trial when our witness was in the hospital, threw out our second witness (Toedebusch) from the courtroom, and gave a $9,999.99 damages award to SGRV on a $2,000 rent dispute that had been previously awarded. Deforest even awarded over $10,000 in legal fees to SGRV's lawyer, Scott E. Williams. Mark was sued for the Interference of a Contractual Relationship and SGRV won with a $0-dollar award plus $5,000+ in legal costs. SGRV's lawyer, Scott E. Williams, successfully ballooned a disputed $2,000 rent judgment into over a $22,000 SGRV judgment. Deforest did this for her buddy Scott E. Williams because he was also a part-time East Mesa justice of the peace. Deforest denied our lawsuit for any recovery of stolen monies by SGRV and violated federal service dog laws.
Deforest was forced to resign in 2012 by the presiding Justice of the Peace for Maricopa County, C. Steven McMurry, because she was dishonest about her educational background and failed to take required legal classes. Our efforts to reverse our travesty of justice were denied, this included our: Fraud of the Court Motion, Appeal, Judge complaint against Deforest, and Bar complaint against Williams. In fact, SGRV's former owner recently attempted to foreclose on our home with that wrongful ballooned judgment even though the previous debt was not his to collect and had been forgiven, violated fair debt collection laws with no efforts to verify the debt, and was past the five-year Statute of Limitations. This is why we want the Arizona law to require Justices of the Peace to be lawyers that follow the law.


 
           THE PEORIA POLICE DID NOTHING TO PROTECT MILLIE TOEDEBUSCH FROM CRIMES
We are remembering Millie Toedebusch this week because her memorial service is this Saturday. Most of Ms. Toedebusch's family lives out of state and were never aware of the abuse and fraud that she suffered in the last years of her life. We were in constant contact with Ms. Toedebusch and only could provide our shoulders for her to cry on. It is hoped that her elder abuse story helps to make people more aware of this vicious crime against the elderly.
Ms. Toedebusch was defrauded by our former senior housing, Sun Grove Resort Village (SGRV). Her name was given to the Peoria Police in 2010 as a SGRV elder abuse victim. Officer Shari Howard told us the Peoria Police had no interest or manpower to worry about elder abuse. Peoria Police Chief, Roy Minter Jr, hung up on us when we requested the opening of our complaint and provided our private detective's SGRV crime report. Ms. Toedebusch had three more criminal incidents that the Peoria Police did nothing about in the last three years.
Ms. Toedebusch had her storage facility robbed at Vista Del Rio of her Christmas decorations and an expensive dish setting. The new scam by senior housing facilities is to hire caregivers from an outside firm so the senior housing is not responsible for licensing and thefts by the caregivers. Vista Del Rio's "GREEN GIRLS" stole Ms. Toedebusch’s jewelry. She hired a former SGRV employee, GEORGIO MORABITO, to help her move and sell some antiques. Mr. Morabito stole $1,000 and many boxes of priceless antiques. We traced Mr. Morabito to help Ms. Toedebusch. We discovered that changed his business name from Morabito's Antiques to Angelo's Antiques (his middle name) after his scam. The Peoria police never interviewed Mr. Morabito for his crime against Ms. Toedebusch. The Peoria police told us that they did not have the manpower or interest to worry about elder abuse and fraud.
We warned Ms. Toedebusch that Mr. Morabito was untrustworthy. Mr. Morabito was going to testify about SGRV's crimes at our July 2010 trial but he canceled the day before our trial. Mr. Morabito had been threatened by SGRV's manager and attorney that he would his lose SGRV job if he testified. We reported this WITNESS TAMPERING to the judge and Arizona officials, but that criminal activity was also ignored in the Arizona Badlands.
 
 THE ARIZONA ATTORNEY GENERAL DID NOTHING TO PROTECT

SALLY BYERS
Millie Toedebusch was not the only elder that lived at SUN GROVE RESORT VILLAGE (SGRV) that filed formal fair housing rights violations charges. The other SGRV older resident was SALLY BYERS. In March 2009, Ms. Toedebusch and Sally Byers went to the Arizona Attorney General's Office to see TERRY GODDARD. Their complaint was that SGRV's manager was violating their fair housing rights. SGRV's Scott Green labeled residents that complained about the poor and dangerous living conditions as "MALCONTENTS." Both Toedebusch and Byers were labeled by Green as malcontents and were punished by withholding services, abusive verbal attacks, and exorbitant raising of rents. Mr. Goddard told Toedebusch and Byers to hire a lawyer and failed to stop the illegal landlord Retaliation, Arizona law ARS 33-1381. ARS 33-1324 is the failure of the landlord to maintain a fit premise.
After Toedebusch and Byers attempted and failed in their fight for their legal rights the SGRV RETALIATION escalated. They both were barred from the game-room and were blocked from playing bridge. They played Bridge on the patio but were told to stop otherwise SGRV would make them pay a monetary fine. Toedebusch's refrigerator broke and her food spoiled, and it took months to have it repaired. Byers had an additional $500 increase to her monthly SGRV rent. Sally Byers fell at SGRV and permanently injured herself. She lived on the second floor and had to use the slippery stairs since the SGRV elevator was broken. She had to move to her daughter's house back east and was forced to pay three months for her empty SGRV apartment (over $6,200). Ms. Toedebusch lost $4,872.80 from SGRV’s baseless lawsuit.
Ms. Byers recently passed away and was another victim of Arizona elder abuse. Arizona law enforcement did not to follow the state/federal laws and failed both Ms. Toedebusch and Ms. Byers. Ms. Toedebusch’s memorial service is this Saturday. We took these elder abuse incidents to several attorneys. We were told that you cannot make the police follow the laws. This is especially true in the Arizona Badlands.
It is interesting to note, that the Arizona Attorney General, Terry Goddard, that declined Ms. Toedebusch’s fair housing complaint is the brother of the attorney, Tim Goddard, who failed to appear at her trial. Ms. Toedebusch never had a chance for any justice in the Arizona Badlands.
