CHARGES BEING FILED AGAINST ARIZONA REGISTRAR OF CONTRACTORS EMPLOYEE - BAD CONTRACTOR ROBERT FREUND

 

We were defrauded and attacked by a bad contractor and the Arizona Registrar of Contractors (ROC) declined our complaints. The bad and dangerous contractor is Robert Freund who operates Palmer's Kitchen, Bath, & Beyond LLC and Palmer's Plumbing dba Ben Franklin Plumbing.

ROBERT FREUND
This contractor was hired in May last year to repair an under slab water leak in our kitchen. The workmanship did not meet code and there was intentional sabotage (a crimped kitchen water line). The contractor was operating with a suspended license since he did not have a Qualified Party overseeing the work. After the contractor was fired we received telephone threats from his employee, Derrick King, who demanded $7,000 cash, refused to return our house key and alarm fob, and vowed to get even by any means.

A Police report was filed and the criminal problems escalated until the court approved Injunctions Against Harassment against Robert Freund and Derrick King.  Our local Home Owners Association in Sun City West, PORA, no longer recommends Robert Freund's contractor companies because of too many problems and complaints.
 
Complaints were filed to Registrar of Contractors (ROC) on January 17, 2014 and on June 30, 2014 our ROC Complaints were declined. The ROC declined us because we failed to allow the contractor access to our home at the time of the ROC inspection and that we refused to allow the contractor the opportunity to fix the poor workmanship. The ROC inspector, Stephen Lawton, denied the contractor access to our home. We had approved the contractor access to our home at the time of inspection since we hired a guard to protect us. We had the right to deny the contractor the opportunity to fix the poor workmanship because the contractor had his license suspended for nearly two months after we had fired him. He did not have the proper credentials to repair his poor workmanship on our job. Our home repair contracting job was started May 28, 2013 but Robert Freund was not qualified to write a contract for it because he had lost his Qualified Party on April 23, 2013. 
 
The ROC inspector has lied on the few documents we received and lied because he was the one who refused the contractor access to our house and not us. The Arizona ROC is covering up this mess by failing to provide public documents as requested in our Public Document Request. The Arizona Governor, Jan Brewer, and other Arizona Officials are ignoring this Travesty of Justice.

This is the fourth in a series of articles about dangerous problems at Sun Grove Resort Village (SGRV) property, a senior living facility located in Peoria, Arizona. This property is owned by the bank through a repossession. Arizona Officials are allowing the problems to be not totally repaired. Arizona Officials are allowing the dilapidated and dangerous senior living facility property to be sold and just pass on all the problems to a new unsuspecting buyer. That is wrong!

The first article posted on the internet was concerning the nine extremely dangerous kitchen violations which was discovered by a recent inspection by the Maricopa County Environmental Services in August this year. The second article posted on the internet was concerning the continuous mosquito problems caused by a moldy fountain discovered by a recent inspection by the Maricopa County Environmental Services in June this year. That mold article shares our SGRV toxic mold documentation and how SGRV hide the toxic mold problem with a phony mold report. The third article focused on the fact that SGRV is a “fire trap” because of many property problems.  This is the fourth and final article which focuses on other Miscellaneous Property Problems at SGRV.

We filed formal complaints of elder abuse and senior financial exploitation against SGRV with the Peoria Police, Arizona Attorney Generals, Maricopa County Attorneys, HUD, the FBI, and the United States Attorney General. None of the state and federal officials interviewed any of our sixty six witnesses. Nothing was done by state and federal law enforcement to stop the criminal activities at SGRV.

We hired a retired policeman and private investigator, Jacob Mueller, to interview some witnesses before they died. Mr. Mueller’s November 21, 2011 found criminal activities and unsafe living conditions at SGRV. This letter and the long written report of Mr. Mueller’s interviews of the SGRV victim was supplied to both state and federal officials. Nothing was done to stop the SGRV criminal activities or fix the SGRV dangerous property problems.

In September, 2013 Joanne Weinkauf-Donavan had a fire in her SGRV apartment. The 72-year old sick senior barely escaped with the help of her Hospice Caregiver.
 
Ms. Weinkauf-Donavan’s daughter Tonia Chambers put out a “plea for help” for her mother because SGRV broke all their promises of help, SGRV kept the furniture not destroyed in the fire, SGRV is made no effort to replace her mother’s belongings, and that SGRV was still demanding rent payment. Ms. Chambers stated that the SGRV had mentally harmed her mother and that her mother was forced to live in a SGRV with no furniture. Ms. Chambers asked the question after she received no help:
 
“How can a community that is basically funded on senior income be so reckless and lack resources when those same seniors are in need?”

We just spoke to Tonia Chambers and received an update about her mother. Ms. Chambers stated that they stayed at SGRV to help her mother after the fire. SGRV rented the SGRV apartment #1027 for her, her husband, and mother to live. She reported the SGRV apartment had made them sick because of the awful smell. I informed Ms. Chambers that was our SGRV apartment #1027 which was full of toxic mold. It appears that SGRV had never removed the toxic mold even after four years since we moved away from the dangerous conditions there.

Ms. Chambers stated that SGRV is trying to blame the fire on her mother’s cigarette smoking but she feels the bad electrical wiring caused the problems.  Her mother had paid the extra SGRV fee which allowed her to smoke in her apartment. She stated SGRV has now made the property a smoke free property by not allowing any smoking. 
 
Ms. Chambers informed us that she had moved her mother to real licensed assisted care facility where her mother’s health is improving.  Ms. Chambers said she had stopped paying SGRV the $50 a month that was demanded when her mother moved. She feels the $1,500 that SGRV demanded was unwarranted because of her mother’s personal property losses and because the fire was caused by SGRV’s bad electrical wiring.

Ms. Chambers reminded us that they were misled by A PLACE FOR MOM because that Elder Care Referral Agency (ECRA) guaranteed that SGRV was a licensed assisted living facility but it was not properly licensed. Ms. Chambers said she complained to A Place for Mom about the false advertising but she never received any response from the ECRA. We informed Ms. Chambers that we had the A Place for Mom false internet advertising contract which was signed by  SGRV’s felon manager. We informed her that we turned the contract over to the authorities (Peoria Police, Arizona Attorney General, and the FBI-IC3)  but the state and federal officials have done nothing to stop the SGRV false internet advertising. Ms. Chambers informed us that she is moving her mother back to Wisconsin where the state better protects the elderly with stronger senior protection laws.

A former SGRV senior resident, Pat Forst, filed complaints with the Peoria Fire Department that SGRV elevator phones did not work properly. Mr. Forst was also concerned that many SGRV residents that could not walk and rode scooters were forced to live on the second floor. SGRV only has two elevators that services the 86-unit apartment complex. Mr. Forst suffered extensive Landlord Retaliation by SGRV’s former manager, Scott Green, for filing complaints with the fire department while trying to protect other SGRV elderly residents.  Not much was done by the Peoria Fire Department except check the elevator phones and cite SGRV about that problem. They SGRV elevator phones quickly broke later after the follow-up inspection.
A prime example of the poorly working SGRV elevators was what happened to the SGRV resident Pam Kline. Ms. Kline used a scooter because she could not walk. SGRV put her in an apartment on the second floor after her roommate, Clay Haning, passed away. Ms. Kline’s dog, Buddy, was hung by SGRV's elevator because it did not properly reopen the door when Buddy jumped out of the elevator while he still was on his leash. SGRV did nothing about the death of Ms. Kline's dog.

SGRV is a fire trap with the following problems:

1.  No fire alarms on the outside of the eleven separate SGRV buildings,
2.  No fire drills,
3.  Poorly working emergency call systems in the 86 SGRV apartments,
4.  Dangerous and poorly maintained electrical wiring,
5.  Often broken emergency elevator phones,
6.  Insufficient number of elevators to quickly evacuate the elderly residents with scooters living on the second floor,
7.   Poorly working elevators that are often broken, and
 8.  Overgrown dry landscaping which is a fire hazard.

SGRV is a poorly maintained senior living property that has extensive kitchen problems, dangerous toxic mold, and it is a FIRE TRAP.
 
SGRV should not be sold but it should be destroyed to protect the public.

TOXIC MOLD AT SENIOR LIVING FACILITY - SUN GROVE RESORT VILLAGE - PEORIA, ARIZONA


TOXIC MOLD PROBLEMS AT SGRV

Sun Grove Resort Village (SGRV) is a senior living facility located at 10134 W. Mohawk Ln., Peoria, AZ 85382. SGRV was built nearly 30 years ago. SGRV consists of 11 buildings which house 86 separate apartments and a main club house/office/dining room.  In May, 2006 the former 20 SGRV owners purchased the property for $4.1 million as an investment from the Oakdale Heights/AREI Ponzi Scam. The SGRV owners took possession of the property in 2008 when the Ponzi Scam collapsed. They had to put an additional $400,000 in order to keep the senior living facility in operation until they could sell it after the recession. The SGRV was poorly maintained and the seniors moved out of the distressed and dangerous senior living facility. The property never could be sold. The bank repossessed the senior living property this year and is now trying to sell this “slum property.”

The SGRV property has extensive mold problems plus poor and dangerous living conditions of: bad electrical wiring, dilapidated buildings, poor kitchen conditions, obstructed walkways, a cockroach and bug problem, and poorly maintained landscaping. The Sun Grove Resort Village (SGRV) mold and property problems are extreme health hazards to the residents and the public. The SGRV residents need to be evacuated and the SGRV buildings need to be destroyed.


SGRV MOLDY FOUNTAIN
The Maricopa County Environmental Services was called out for a mosquito infestation complaint on 05/20/2011. The inspector found mold in the front SGRV fountain that was causing the mosquito problem.  This mold in the front fountain was found again by the Maricopa County Environmental Services on another mosquito infestation complaint on 06/20/2014.

We had toxic mold in our SGRV apartment that was making us and our dogs sick so we did a mold test. Our 10/18/2009 Pro-Lab

 apartment mold study kit found unacceptable levels of the molds Bipolaris and Drechslera in our SGRV apartment. We found the worst "Toxic Black Mold" STACHYBOTRYS
at SGRV which can kill people .

The Advanced Mold Inspections Com states:  “BIOPLARIS: A widespread fungus that is most frequently associated was grasses, plant material, decaying food, and soil. It is common to both indoor and outdoor environments. Older obsolete names include Dreschslera and Helminthosporium. This fungus produces large spores which would be expected to be deposited in the upper respiratory tract. Various species of this fungus can produce mycotoxin – sterigamatocystin which has been shown to produce liver and kidney damage when ingested by laboratory animals.   DRESCHLERA: Conidia (spores) dimension 40-120 x 17-28 microns. Found on grasses, grains and decaying food. It can occasionally cause a corneal infection of the eye.”
We have testimony from the following people that SGRV had a mold problem, they are:

1.   07/29/11 – John Eggen - son of former SGRV resident Lil Eggen, found mold in his mother’s apartment.
2.   11/15/12 – DeDe Stockton - former SGRV Concierge for one year saw mold in SGRV apartments.
3.  11/24/12 – Fredda Sharp-former SGRV Activities Director for 5 years saw mold in SGRV apartments.

Fredda Sharp was told by SGRV’s manager and 2005 Medicare Fraud Felon, Scott Green, to keep the mold problem quiet. SGRV's Executive Director, Scott Green, was terminated on 08/28/12 when it was discovered that he pled guilty to stealing $70,000 in nearly 2,700 bogus Medicare Claims in 2005.
 
NEW SGRV TOXIC MOLD DISCOVERY
 

Recently, toxic mold was found in the SGRV men's bathroom during the repair of a plumbing leak this year. The picture of the SGRV toxic mold leak was provided by the former SGRV Sales Manager, Lucy Huerta. The toxic mold was not properly cleaned up which puts all the elderly residents living at SGRV at extreme risk in the main building and in the dining room.
 
Toxic Mold was found in the men's bathroom this year, which is located in SGRV's main building near the dining room.
 

THE SGRV TOXIC MOLD COVER-UP



SGRV’s attorney, Scott E. Williams, hired a very small inspection company, ENVIRONMENT CONSULTING, INC. (ECI), to inspect our SGRV apartment for mold.  The Arizona Corporation Commission records show ECI was incorporated in September, 2008 and did business out of Miranda Mayo’s (the owner) house.  ECI’s Brandon White did the mold test at our SGRV apartment on 10/16/09. He falsely stated that he found no mold in his 10/20/09 ECI mold report.

This mold report was simply a phony mold report that was produced by attorney Scott E. Williams to disprove our nationally known mold inspection company, Pro-Lab. SSPTM, Inc.’s, positive mold results. ECI was out of business on 02/03/11 because the Arizona Corporation Commission closed the company for nonpayment of their annual dues.  ECI closed BEFORE HUD’s Catherine Ross-Perry verified the authenticity of the ECI mold report on 05/03/11. Also, ECI used the mold lab, Tierra Science, which had been closed due to inaccurate tests. The ECI mold report has no credibility because it was free, the ECI inspector Brandon White went to work for Scott E. Williams, ECI and Tierra Science Lab were closed, and the inspector Brandon White lied to HUD and the Arrowhead Justice Court. HUD failed to discover that the ECI mold report was phony documentation generated by SGRV’s Felon, Scott Green, and SGRV’s attorney, Scott E. Williams.


ECI was simply a fly-by-night mold company that had no freestanding business

ECI was underfunded since Arizona had to close the little over two-year business for the nonpayment of its state fees.   ECI’s Brandon White reported in his 05/03/11 HUD interview that he gave SGRV a $300 discount because he was late generating the report. That was a lie because the report was completed, sent by email, and mailed by Certified Mail on 10/20/09, which is only four days after the test was done and not the seven days he reported to HUD. Brandon White lied because on 10/22/09 he waived the entire $427.23 ECI mold report fees for SGRV.
Finally, Brandon White lied to HUD stating he had no business relationship with Scott E. Williams. Brandon White was hired by Scott E. Williams to be the mold consultant for Williams’ lawyer group, the ASSOCIATION OF LANDLORD TENANT ATTORNEYS (ALTA). On 05/06/2011, Brandon White spoke before ALTA, which was only three days after his perjurous HUD testimony.
Brandon White benefited by producing a free false mold report because he was hired by Scott E. Williams’ ALTA group of 20 attorneys after ECI had closed. According to the Arizona Corporation records Brandon White started his own company, Enviroscience Consulting, Inc. According to the Arizona Corporation Commission records Brandon White started his company on 07/14/11, which is only a little over two months after he had lied to HUD. We suspect Scott E. Williams enabled Brandon White to start his own company. We suspect that was done to hide the fact that SGRV was and is full of mold, and it is a very dangerous and deadly property.

When we lived at SGRV with our service dog, Wheeler, who got deathly sick from the toxic mold.  We had to move because the leaky moldy SGRV apartment was not safe for us. SGRV’s felon manager, Scott Green, and SGRV’s attorney, Scott E. Williams refused to remove the mold in our apartment and refused to let us move to a mold-free apartment. They used their falsified mold report stating there was no mold but that was untrue. 

We were all getting very sick from the toxic mold at SGRV. My wife, Carol, is a

post-liver transplant patient and that SGRV toxic mold exposure started the rejection of her transplanted liver. Our dogs, Wheeler, Bridget, and Brittany, all died of liver cancer. We have spent all our monies in hospital fees and doctor bills in an effort to keep Carol alive. We have been denied any justice for the violations of our Fair Housing Rights by HUD and the Arizona Attorney General.
SGRV's attorney, Scott E. William, sued us twice for the $3,500 bill that we refused to pay because our civil housing rights were violated by SGRV. These law suits were filed in the same Arrowhead Justice Court at different times. We lost because the court refused our evidence and refused to delay the trial because our witness was in a coma in the hospital. We have over $23,000 in judgments (over $10,000 of that is in attorney's fees). Our second inept judge Melanie Deforest was later forced to resign because she had lied about her qualifications and the lack of a college degree. Our Fraud of the Court Motion and our Appeal to this gross injustice have been denied.
It helps that Scott E. Williams was hired in 2004 by the Maricopa County Board of Supervisors to represent all elected officials of Maricopa County on election matters and he also handles the evictions on all the Maricopa County rentals. Scott E. Williams is the "Evictions King" in Arizona with over 100,000 evictions in 20 years because he is "PROTECTED." Williams wrote the Landlord/Tenant Act which gives renters no rights. Scott E. Williams is cashing in on the victims of slumlords and Arizona allows his criminal, immoral,  and unethical activities!
