We taught classes for several years as THE REAL FACES OF ELDER ABUSE until Carol has become too ill from her transplanted liver rejection which was caused by her exposure to toxic mold at SGRV. We still present elder abuse protection law ideas to our state and federal lawmakers. We still write our daily Facebook "Mark Fairall" about elder abuse crimes and information on how not to be a victim of elder abuse and senior financial exploitation.

Robert Freund filed a Baseless "Junk" Lawsuit against us on December 12, 2013, for $3,800.00 plus legal fees after making three prior different amount monetary demands.
 
We paid Mr. Freund nearly $14,000 to repair an under-slab kitchen water leak and rebuild the kitchen cabinets. We discovered over 60 problems of poor workmanship and intentional contractor sabotage (a crimped waterline). After our Beach of Contract email, we also experience two telephone threats of violence from Robert Freund's employee, Derrick King, plus he refused to return our house key and alarm fob unless he was paid $7,000.00 cash. A Police Report was filed on August 08, 2013. This contractor contract dispute escalated in more criminal activities. Injunctions Against Harassment were granted against Robert Freund and Derrick King.
 
The Court has denied all Motions to Dismiss this Baseless Lawsuit. The Court ignores the Rules of Law for the filing of the Plaintiff's Pleading within the proper time schedules.  Robert Freund misuses the Court as a collection agency to harass and defraud the elderly for payment of unearned monies.
 
Our Public Adjuster failed to follow the contract we signed and closed out the claim without a "final walk-though" and without our approval. Our Public Adjuster showed favoritism to Robert Freund because they were working on a claim on his house and he refers many clients to them. Our Public Adjuster canceled our contract and all debts to them. Our Public Adjuster cost us thousands of dollars in hotel fees and repair costs.

ARIZONA OFFICIAL'S ENABLE BAD CONTRACTOR, ROBERT FREUND, TO ABUSE AND DEFRAUD THE ELDERLY


DO NOT USE PALMER'S KITCHEN, BATH, & BEYOND LLC or PALMER'S PLUMBING DBA BEN FRANKLIN PLUMBING
 
We have suffered telephone threats, attempted extortion, a baseless lawsuit, intentional criminal sabotage (a crimped waterline), and criminal damages to our property (cut electrical lines to sprinkler system, disabled motion detector lights, and attempted murder with the nailing and slashing of all of our four car tires) after we fired the contractor Robert Freund for Breach of Contract on August 08, 2013.
 
Judge Gerald Williams approved Injunctions against Harassments against Robert Freund (owner of the contractor companies) and his employee Derrick King on May 09, 2014. Judge Williams said the criminal activities against us "went to pattern" after Derrick King, who has a violent criminal record, threatened us twice on the phone on August 08, 2013, demanding $7,000 cash and refusing to return our house keys and alarm fob. Mr. King stated he would do anything to collect the remaining balance and that we did not want to know the severity of  his threats. This attack happened even after Freund's contractor companies were paid $13,700.14 for delayed substandard home repairs that did not meet building codes. Three Police Reports have been filed in the past year for telephone threats and criminal damages.

Our losses are:
 
1. $30,000 for the repair of the substandard home repair work,
 
2. $10,000 for a security camera system/payment of security guards/lawsuit expenses/medical bills,
 
3. $20,000 for the 10% loss of value to our house because the mold was not properly removed, and
 
4. Damages to our health because this stress caused my wife, Carol, to have a stroke and I am having increased seizures.
 
Arizona Officials Do Nothing
 
We filed Complaints #2014-250 and #2014-251 against Robert Freund's plumbing company and home repair company on January 17, 2014 with the Arizona Registrar of Contractors (ROC) listing with pictures of over 60 incidents of poor workmanship and sabotage. Our ROC Inspector, Stephen Lawton, barred Robert Freund from our home because of the threats and criminal damages. The Police told us we had the right to protect ourselves and not allow the bad/dangerous contractor into our home because we feared for our lives with the Arizona Castle Law.
 
 
It took five and a half months to receive the ROC's dismissal of our complaints on June 30, 2014, because we failed to allow the contractor his rights to inspect our home and repair the problems. This was very odd because the contractor had no rights because at the time of our home repair his plumbing licensed had expired and was not renewed plus he had no required Qualified Party (a state approve licensed contractor) for his home repair company. Robert Freund was operating as an Unlicensed Contractor the whole time of our home repair job, May 28, 2013 to August 08, 2013, and had no contractor legal rights.
 
 
The ROC is being run by William Mundell, a former state lawmaker, who is allowing the Arizona Legislature to drain the Contractor Recovery Fund since he was appointed by Governor Brewer in 2009. The 2013 audit by the Arizona State Auditor, Debbie Davenport, stated that the ROC is failing because of: the slowness of complaint processing, the wrongfully closing complaints, the poor follow through on required contractor home repairs, no verification that required contractor payments to the homeowners were ever made, the failure to escalate discipline against repeat contractor violators, and that homeowners are not getting the relief they are entitled by law from the Contractor Recovery Fund that has insufficient funds to pay the approved claims.

The ROC failed us by failing to timely update its website concerning the problems of Robert Freund's contracting companies' licenses. The ROC failed us by wrongfully closing our contractor complaints on Robert Freund's Unlicensed Contractor Companies.

 
 
The ROC declined us the day before the ROC's policy change to eliminate the "15-day Window for Corrective Complaints" which allowed the contractor to repair the their problems. On July 01, 2014, the ROC went to a "Directive System" which posts all contractor poor workmanship issues publically for two years in order to warn Arizonans about bad contractors.

This is critical to us because Robert Freund failed to contain the mold removal, exposed and contaminated our entire house to mold, and failed to obtain the required Mold Removal Certificate from the mold specialist as required by law. That is probably because Robert Freund does not pay his subcontractors because we received many desperate calls for help from them.

All emails, letters, and phone calls have been ignored by ROC's William Mundell, ROC's Stephen Lawton, and Governor Brewer.
 
We filed a complaint #14-01841 with the Arizona Attorney General Tom Horne on February 10, 2014,  listing five laws Robert Freund is breaking. Tom Horne has done nothing.

Our ignored letter dated July 14, 2014, to Governor Brewer lists five state laws and six contractor law violations that calls for the IMMEDIATE REVOCATION of all Robert Freund's contractor licenses. That letter and information was posted to the Internet on July 25, 2014, as: "Arizona Registrar of Contractors is Failing Arizona Homeowners."

Homeowner Associations in the Sun Cities
are taking Action
 
Both the Homeowners Associations in the Sun Cities Area, SCHOA and PORA, no longer recommend Robert Freund's plumbing company and home repair company for the past several years because they have received too many complaints due to poor workmanship. The ROC has many complaints filed and being filed against Palmer's Kitchen, Bath and, Beyond LLC and Palmer's Plumbing dba Ben Franklin Plumbing.
 
 
Sadly, the Arizona Officials are enabling this bad and dangerous contractor, Robert Freund, to continue to abuse and defraud the elderly by not stopping his criminal activities.

ARIZONA REGISTRAR OF CONTRACTORS IS FAILING ARIZONA HOMEOWNERS

SHOULD BE FIRED

 

It was reported last year by Arizona State Auditor, Debbie Davenport, that the ROC is failing the Arizona Homeowners.
 
The audit determined that the ROC is failing because:
 
1. An extremely slow process which can take more than a year to resolve a homeowner's contractor complaint.
 
2.  Extremely poor follow-through which often wrongly closes homeowners' contractor  complaints before the contractor's required repair work was properly completed.
 
3.   No verification that required contractor reimbursements were ever paid to the homeowners.
 
4.  High rate of staff turnover which causes additional delays of having the homeowner's contractor complaint reassigned to a different staff member.
 
5.  Failure to escalate discipline remedies against bad contractors that have a repeat number of homeowners' contractor complaints.
 
6.  The homeowners are not getting the relief they are entitled from the Recovery Fund. The state lawmakers drained the fund last year of $8.5 million leaving only $220,419 to pay approved claims of $3.9 million.

WILLIAM MUNDELL - ARIZONA ROC DIRECTOR
We are very familiar with a bad and dangerous contractor that is praying upon the elderly in the Sun Cities Area, PALMER'S PLUMBING dba BEN FRANKLIN PLUMBING and PALMER'S KITCHEN, BATH, & BEYOND LLC.  Both companies are owned by Robert Freund and the quality of work has plummeted since the death in 2007 of his father who owned the business and the 2013 resignation of the co-owner T.J. Myers.
 
The ROC failed us by:
 
1.  Not properly updating its website with contractor license information.  Freund's plumbing company license was expired and his contractor company did not have the required Qualifying Party the entire length of our home repair job from  May 28, 2013, to when they were fired on August 08, 2013, for Breach of Contract. In fact Freund's contractor companies were Unlicensed Contractor Companies.
 
2.  Our contractor complaints (2014-250 & 2014-251) took the ROC Inspector, Stephen Lawton, over 5 1/2 months to process. Mr. Lawton told us he was overwhelmed with 85 contractor complaints, the fact that he had no support staff, and that the ROC has the inspectors working from their homes while not providing a proper office location.
 
3.  The ROC declined our complaints on June 30, 2014 based on a technicality because we refused to allow Freund back into our home after we were threatened by his employee, his employee refused to return our house key and alarm fob, and we found intentional criminal sabotage to our home (waterline to kitchen sink was crimped). Mr. Freund was not entitled to have any Contractor Rights because he was operating without properly approved license and was in fact an Unlicensed Contractor.
 
4.  The ROC ignored our rights to protect ourselves when we feared for our lives. The police told us in our three criminal damage police reports that the Arizona Castle Law gave us rights to deny their access to our home. The ROC Inspector, Stephen Lawton, even blocked their access to our house to protect us. We even hired a policeman to protect us in case they showed up at the inspection of our home.
 
5.  The ROC Inspector, Stephen Lawton, told us that our 60 documented problems of substandard workmanship, intentional sabotage of our plumbing, and harassment was the worst the ROC had ever seen.  Judge Gerald Williams agreed and on May 09, 2014, he issued Injunctions against Harassments against Robert Freund (contractor company owner) and Derrick King (contractor company employee).
 
6.  Our ROC Inspector told us the Freund is no longer using the Ben Franklin Plumbing Franchise advertising because his plumbing license has expired. However, our research shows that Freund is still in the plumbing business which is illegal.  Freund still lists T.J. Myers on has website as his contractor company co-owner which verifies his continuous false advertising.
 
7.  Freund hired a new Qualifying Party, Derrick King, and he was the employee who threatened us stating he would do anything thing it takes to collect the remaining $3,800 after we had already paid nearly $14,000 for substandard and safety failing work (mold was not removed properly). After Mr. King threatened us we had our electric lines to our sprinkler system cut, motion detector lights disabled, and all four tires slashed and nailed in such a way to cause a blowout if the car was driver at a higher rate of speed.  The judge agreed that this was attempted murder and "went to pattern" because of Mr. King's violent criminal past and the threats he made to us. The ROC never should have allowed Mr. King to be a contractor.

We wrote the below letter to Arizona Officials but we have received no response.

This letter is written to inform you that the Arizona Registrar of Contractors (ROC) is doing less and looking for ways to not perform their duties of protecting the public from bad contractors. We need your help to require the ROC to properly enforce our legal rights and prosecute the bad and dangerous contractors, Robert Freund (company owner) and Derrick King (qualifying party).
We filed two complaints on January 17, 2014, against Palmer’s Plumbing dba Ben Franklin Plumbing (ROC complaint #2014-250) and Palmer’s Kitchen, Bath, & Beyond (ROC complaint #2014-251). We received Complaint Dismissals dated June 30, 2014, stating that we violated the contractor’s rights to inspect our property and have the opportunity to repair the damages. A Police Report was filed on August 08, 2013, (#2013-151570) for telephone threats and refusal to return our house keys. MCSO Deputy Dias told us that we had the right to forbid them from our home under the CASTLE LAW because we were afraid for our lives.  The ROC Inspector, Stephen Lawton, waived that contractor inspection and repair rights in order to protect us because of the threats and intentional criminal damage sabotage in our home (a crimped kitchen waterline).
Our ROC complaints have listed over 60 contractor problems and poor workmanship with pictures due to an under slab water leak and kitchen flood.  This contractor mess has cost us nearly $14,000 in payments to the contractor and now he is suing us for an additional $3,800 plus legal fees (Lawsuit #2013-222467RC) even after when we cancelled the job on August 08, 2013, for BREACH OF CONTRACT. We have had to pay new contractors thousands of dollars to clean up the mess. This poor workmanship also exacerbated my wife’s transplanted liver rejection because the toxic mold cleanup was not correctly done.
 
We filed a complaint with the Arizona Attorney General on February 10, 2014 (AG Complaint #14-01841) for the following violations:
1. ARS 32-1151 – Not having a valid contractor’s license,
2. ARS 13-2002 – Submitting forged documents to the court,
3. ARS 32-1129.01 - Breach of contract,
4. ARS 13-1202 -Threatening and intimidating phone calls, and
5. ARS 13-1602 – Intentional criminal damage. 
We wrote the ROC on July 09, 2014, disputing its decision, and to date we have had no response. We listed that at least Six Citations should be issued in accordance to ARS 11-3254, which are violations of:
1. Section 7 – Contractor Committed Fraudulent Acts with court documentation forgeries, filing a baseless lawsuit, and hiring a qualifying party who has a criminal record,
2. Section 8 – Contractor Committed a Felony with threatening phone calls and intentional criminal damages,
3. Section 9 – Contractor made unapproved contract changes and failed to complete contracted work,
4. Section 12 - Contractor failed to follow safety laws by not containing the toxic mold cleanup and failed obtain the required Mold Remediation Certificate,
5. Section 17 – Contractor failed to have the proper license since he did not have a qualifying party at the time of our job,
6. Section 24 – The Contractor’s employee made several telephone threats and refused to return our house keys and alarm fob.
Our contractor problems went beyond a contract dispute to a criminal matter with the telephone threats and suspected criminal damages of the electric lines to our water system being cut, motion detector lights being disabled, stalking, and the slashing and destroying of all our four automobile tires (two more Police Reports were filed -  #2014-004271). We had to hire private police protection and install an expensive security camera system.
The Court approved Injunctions against Harassment on May 09, 2014, against Robert Freund (#CC2014-080145000) and Derrick King (#CC2014-080186000).  Judge Gerald Williams stated: “Our criminal damages went to pattern because of the telephone threats and Derrick King’s violent criminal past.”
We find this ROC dismissal a TRAVISTY OF JUSTICE and need your help to get the ROC to properly do its job and enforce our rights, help us recover some of our losses from the Contractor Recovery Fund, and REVOKE Robert Freund’s contractor licenses.
The Public needs to be protected from these bad and dangerous contractors who use Elder Abuse and Fraud to run their home repair/remodeling contractor companies.

 NOTE:  To answer the many questions on why we hired Robert Freund's companies was the facts that my parents were personal friends with Palmer and Helen Freund, they serviced our plumbing needs since 1978, and they were members of our church. Robert Freund has destroyed the companies after his father's, Palmer Freund, death in 2007 and after losing his co-owner, T.J. Myers in April, 2013.

Dangerous Mosquito Infestation puts the Elderly at risk at Sun Grove Resort Village in Arizona

FOUND AT SUN GROVE RESORT VILLAGE

 
Maricopa County Environmental Services Department – VECTOR CONTROL has just completed an inspection of Sun Grove Resort Village (SGRV) on June 19, 2014 and found a dangerous mosquito infestation in this senior living property (Complaint #CC14-13084). On May 20, 2011 SGRV had the same problem (Complaint #CC11-310225) with mosquitoes in a “green pond” at the front office. This is mosquito problem is a continuous dangerous problem at SGRV which puts the elderly living there at tremendous risk.

The most deadly animal in the world is the mosquito because it kills over a million people a year throughout the world. Seniors have the highest risk of severe diseases of meningitis and encephalitis from a mosquito bite. West Nile virus is spread by mosquitoes that live in standing stagnant water. The symptoms of West Nile Virus is fever, headaches, and body aches but it can progress to the inflammation of the brain, inflammation of the membrane around the brain and spinal cord, and paralyzed muscles. Currently there is no vaccine to protect the public from West Nile virus. The CDC suggests using repellent that has “Deet” in it is the key to preventing deaths from West Nile virus. A new mosquito virus called “Chikungunya virus” is rapidly spreading from the Caribbean and it is much more deadly.

SGRV is a senior living property that has been allowed to deteriorate by the owners for the past six years. This was SGRV property was involved in the AREI/Oakdale Heights Ponzi Scheme that defrauded 2,000 investors of $250 million and hurt 23 senior living facilities and the 2,500 seniors. These properties were used to entice the investors as collateral in California largest real estate based Ponzi scheme. SGRV was one of those properties and the 20 investors just lost $4.5 million when they filed for bankruptcy and were foreclosed upon. Fannie Mae just tried to auction this dangerous property on June 13, 2014 but it was not sold because the property is full of toxic mold, has bad electrical wiring, has dangerous property conditions, and it has a roach/mosquito infestation.

We have been reporting the criminal activities and dangerous property conditions at SGRV for nearly five years to the City of Peoria and Arizona Officials but sadly nothing has been done to protect the elderly. The VECTOR CONTROL inspector has just reported that SGRV property has a huge mosquito infestation in the front fountain and throughout the property in standing stagnant water on walkways. It is hoped that Fannie Mae will destroy the 86 unit senior living property in order to protect the public.
