Mark and Carol Fairall - Elder Justice Advocates


 
Mark was forced in retirement from his bank manager career, at 43, because of a stroke. Carol ended her restaurant management career, at 57, because of a needed liver transplant. After we retired we met at our senior living facility, Sun Grove Resort Village (SGRV). We saw the abuse and corruption there and we fought for the rights of our fellow senior residents. Our fight against elder abuse and senior financial exploitation has mushroomed into our being Elder Justice Advocates. The US Senate – Special Committee on Aging had us post our story about the SGRV elder abuse story and about the SGRV 66 elder abuse cases, 36 seniors have died with no justice. SGRV’s problems started with being involved in a Ponzi scheme and the 20 out-of-state owners who lost $4.5 million on their SGRV investment.

We reported the SGRV Elder Abuse and Financial Exploitation Crimes to the Peoria Police and the Arizona Attorney General. However, the Arizona Law Enforcement failed to interview the SGRV abused victims and failed to discover that the manager of SGRV, Scott Green, was a confessed 2005 Medicare Fraud Felon that made his living scamming the elderly and government. Scott Green was terminated on 08/28/12 but the SGRV crimes of false advertising, baseless lawsuits, and imposter nurse continues today. We presented our documentation to the California Court concerning the mastermind of the Oakdale Heights/AREI Ponzi scheme, James Koenig. That Ponzi scheme defrauded 2,000 investors of $250 million and hurt over 2,500 seniors that were living in the 23 senior living centers destroyed in the Ponzi scheme. Based upon our evidence the judge recently sentenced James Koenig to 43 years in jail. The California judge said this was more than the money but it was elder abuse.

We speak from experience after being abused and seeing many seniors abused and financially exploited. We teach classes and write articles as THE REAL FACES OF ELDER ABUSE. Our emphasis is on how to avoid being a victim of elder abuse and fraud. Elder Abuse and Senior Fraud has become epidemic and the CRIME OF THE 21ST CENTURY with a senior being abused in the US every five seconds. We teach that the key to stopping elder abuse is to prevent it before it happens with knowledge. We write a daily Facebook “Mark Fairall” sharing elder abuse stories, new senior protection law ideas, and tips on senior scams. Finally, we present new senior protection law ideas to our state and federal lawmakers.

 
Mark has been recognized in 2013 by COVINGTON’S WHO’S WHO for his civic volunteer activities. Carol was the runner-up for ARIZONA AARP’S 2013 Andrus Community Service Award. Carol recently received and letters from President Obama and the US Department of Health and Human Services thanking her for her volunteer work and wishing her better health.

April is National Donate Life Month - Arizona Information

APRIL IS NATIONAL DONATE LIFE MONTH
 
National Donate Life Month (NDLM) was instituted in 2003 and is celebrated every April. The NDLM has many state and national activities in April to register organ donors that can give the “GIFT OF LIFE.” The Donate Life Flag is flown in April over hospitals, transplant centers, and all recovery agencies in order to make a visible and unified statement about the importance of organ donations and to show the dire need for organ donors.
 
On March 31, 2014 President Barack Obama issued the Presidential Proclamation stating: “I call upon health care professionals, volunteers, educators, government agencies. Faith-based and community groups, and private organizations to join forces to boost the number of organ and tissue donors throughout our Nation.”  President Obama also stated that more than 120,000 Americans are on the transplant list but 18 of them die every day waiting. Every donor can save eight lives thanks to scientific advances. Lastly, the President urged the Public visit www.organdonor.gov or sign up in your State’s donor registry. The President stated: “As a Nation, let us shine a light on the power of donation. Let us lift up the friends and families of donors and remember those who ensured that in their death, others received life.”
 
Some organ donation facts from DONATE LIFE AMERICA are:
 
1.  An average of 79 organ transplants take place every day in the United States
2.  Over 46,000 patients had their sight restored last year through corneal transplants.
3.  A living donor can provide a kidney or a portion of their liver, lung, pancreas or intestine.
4.  More than a million tissue transplants are performed every year and the need is rising.
5.  As of June 2013, over 112 million people (46%) of the US adult population are registered as organ donors.
6. Every major religion in the United States supports organ donations as the highest expression of generosity and compassion.
7.  There is no cost to the donor’s family or estate for organ donations.

Recent statistics from the USA TODAY show that Arizona is ranked the third lowest organ donor state in the nation at 17.2%.  The top organ donors’ states are: Colorado – 64.4%, Iowa – 62.8%, Montana 62.4%, Washington – 56.7%, and Wyoming – 55.4%. The worst organ donors’ states are:  New York – 11.1%, Michigan – 12.7%, Arizona – 17.2%, California – 25.5%, and Kentucky – 25.9%. It is difficult to get an organ transplant in Arizona because the supply of organs are so low.
 
Last year we attended the DONATE LIFE EVENT at the Arizona State Capitol. We had the honor to meet the “THANKSGIVING MOM” and listened to her story of love. Her only daughter had died in an automobile accident and her organs were used to save the lives of six people. Those six transplant recipients celebrate Thanksgiving with her every year honoring her daughter for giving them the “Gift of Life.” The Thanksgiving mom stated that she knows her daughter is in Heaven but she is so blessed because she feels her presence every Thanksgiving when the people her daughter saved celebrate the holiday together.
 
Organ donation is a subject near and dear to our hearts since Carol received her transplanted liver in October, 2007 at Banner Good Samaritan Hospital. Carol is very active mentoring organ donors and raising awareness and funds for this worthwhile cause. We urge all Arizonans’ to mark the Organ Donor box on their Driver’s License and share life.

Service Dog Laws Are Not Enforced

SERVICE DOG LAWS ARE
NOT ENFORCED

I was illegally charged a “Pet Deposit Fee” in a senior living facility but no one enforces the Service Dog Laws. I was denied my federal and state disabled civil rights. It is against the law to deny access or to charge for a service dog by a landlord.

WHEELER'S MEDICAL SERVICE DOG ID
I was charged $450 for my licensed and trained service dog that assisted me when I had seizures. The Peoria Police, the Arizona Attorney General, and the Department of Housing and Urban Affairs (San Francisco HUD) refused to enforce the service dog laws. Also, the Maricopa County Justice Court denied my claim to recover the illegally charged service dog’s $450 pet deposit fee.

Now, I attempted to rent a condo in Sedona for the summer but I was turned down because I have a licensed and trained service dog. The Sedona landlord told me that no one enforces the service dog laws. Sadly, the Sedona landlord is right.

I just happened to be looking for a companion since my mother had just died. The breeder was recommended by a neighbor and I went to her Sun City house in March, 2003. The breeder had me sit in the middle of the room to see which of her ten dogs took an interest in me.  Wheeler ran to me and jumped into my lap and picked me for his forever buddy.  I had to write a letter saying how I was going to treat Wheeler. The Breeder allowed me to adopt Wheeler. Wheeler always had two birthdays a year, his birthday and his adoption day.

We spent four years together living alone and having fun in my house.  Since I have seizures, Wheeler became trained to be my Service dog.  He pushed the emergency alarm button three different times saving my life.  When we moved to a senior living facility, Wheeler spotted my future wife, Carol.  Wheeler had always been very reserved, but that was not the case with Carol.  Wheeler acted as our honorary Best Man at our wedding.
When we lived at Sun Grove Resort Village (SGRV) Wheeler got deathly sick from the toxic mold.  I just gave our lawyer our 10/23/09 letter to SGRV stating that we had to move because the leaky moldy apartment was not safe for us. Carol, a post-liver transplant patient, Wheeler, Bridget, and Brittany, and I were all getting very sick from the toxic mold at SGRV.  Wheeler passed away last September just like Carol’s two Yorkies, and they all died of liver cancer.  The picture is of Wheeler the night before he died celebrating his birthday early before his Heavenly Birthday.

Bridget and Brittany passed from liver cancer after being exposed to the SGRV toxic mold shortly after we moved to our home. All three of our dogs that SGRV killed are buried in our backyard with little crosses on their graves. 

Our hearts ache from their deaths as we view their little graves daily.

Dear President Obama:
The problem with governmental jobs is that there is no accountability and the officials escape their poor performances into retirement. We presented this problem to the US Senate - Special Committee on Aging. They have passed our failed 1,500+ day old HUD FAIR HOUSING COMPLAINT #091104058 to be reconsidered by the OIG HUD. We have posted our “The Sun Grove Resort Village Elder Abuse Story (SGRV)” online as directed by the Senate’s Special Committee on Aging.
My wife, Carol, is dying of her transplanted liver rejection because the SGRV senior living facility refused the delivery of her anti-rejection medication, refused to fix water leak and toxic mold apartment problems, and refused to accept two Reasonable Accommodation Requests from us and our attorney because we fought for our and others’ fair housing rights. Our attorney even wrote in his 10/09/09 email to the SGRV stating: “Please instruct Scott Green and staff at Sun Grove that they are not to interfere or interrupt the delivery of Ms. Buck’s (now Fairall) medication. This strikes me as clear bad faith and retaliation.” SGRV even refused the free usage of our properly trained and licensed service dog without the illegal collection of a $450 dog deposit fee.
Chuck Hauptman, HUD’s San Francisco former administrator, improperly closed our Fair Housing Complaint against Sun Grove Resort Village on 05/13/11. Mr. Hauptman failed to contact our supporting witnesses, failed to let the HUD Investigator Catherine Ross Perry finish gathering our evidence, and failed to properly consider our evidence. Mr. Hauptman believed the phony statements of SGRV's felon manager Scott Green and the falsified documentation of Green's accomplice attorney Scott E. Williams. Mr. Hauptman told us that he did not want a legal battle with SGRV’s attorney the last year before his retirement. HUD did nothing to verify our fair housing violations complaint evidence or our 27 witnesses.

We had to hire our private investigator, Jacob Mueller, to document our supporting witnesses’ testimonies before they died. Presently we have documented 66 SGRV elder abuse fair housing cases and 35 of those seniors have died while being ignored by state and federal officials.  HUD's Chuck Hauptman just closed our complaint to clear his desk the day before his vacation. Mr. Hauptman retired on 12/14/12 from a 40+ year HUD governmental career but he should have been fired for his poor performance. Mr. Hauptman’s HUD Region #9 had the worst overall performance in the presently faltering HUD, which is performing at the 10% level that it did in the 90’s. Former HUD Secretaries Henry Cisneros and Jack Kemp did a study in 2009 which concluded that HUD should be stripped of it fair housing enforcement because of its lack of performance.
Thank you for your kind note to Carol on 12/20/12 wishing her well. My wife treasurers your kind words. Carol’s health has gotten much worse and she is unable to do anymore public speaking on preventing elder abuse and fraud. We now write a daily Facebook and Newspaper Articles trying to protect seniors and trying to get better senior protection laws passed. We have a huge following and have received national recognition for being Elder Justice Advocates.

Our Elder Abuse prevention article "The New Elder Care Referral Agency (ECRA) Problem" was printed by AARP on 11/25/12. The article details the new telemarketing industry calls to seniors in order to place them in senior living facilities. The IC3 (FBI Internet Fraud) reports that seniors lose $264 million a year on false Internet advertising. The elderly are desired targets of telemarketing crooks. 
 
ECRA INFORMATION

ECRAs are not free because the senior living facility pays an average of $3,500 per person if the senior decides to live in the place that the ECRA referred. This raises the cost of the senior living facilities expenses which is passed on with higher rent cost. The ECRA telemarketers call the senior housing facility kickback a "Bounty". Washington State is the only state that has the ECRA REGULATION LAW that protects seniors.

ECRAs provide senior living facilities 30% to 50% of the leads for marketing to senior living facilities. Sun Grove Resort Village (SGRV) relies heavily of ECRAs and misuses it by stating it is an licensed assisted living facility which is a lie. Seniors who use the Internet from all over the United States and the World are mislead by SGRV's internet advertising. Arizona does not have the Unlicensed Assisted Living Facility Law which would allow the Arizona Department of Health Services the legal ability to regulate and close dangerous imposter assisted living facilities.

The 20 SGRV owners are desperate since it has a very low occupancy rate in its 86 units of a little over 34%. SGRV's low occupancy is caused because the SGRV property is dangerous because it is dilapidated and full of toxic mold. The SGRV owners have just fired Karl Nunley and Susan Nunley from managing the property. SGRV was previously managed by the senior living management company SENIORITY INC (a subsidiary of American Baptist Homes of the West -ABHOW). SGRV fired Scott Green in August, 2012, who managed property since 2005. Scott Green was convicted in 2005 of Medicare Fraud. The SGRV's owners continue to use false Internet advertising and  the following Internet Sites falsely advertise that SGRV is an assisted living facility are:

ANOTHER DUPED ELDER AT SGRV

Joanne Weinkauf-Donovan, a 72-year old senior with dementia, was recently duped by A PLACE FOR MOM because she was told by them and SGRV's management that SGRV was a licensed assisted living facility. Ms. Weinkauf-Donovan just had to move to a real licensed assisted living home to meet her medical needs. Ms. Weinkauf-Donovan's SGRV apartment burned and all her belongings were destroyed. SGRV has made no effort to refund any of her money because of their false advertising. SGRV has made no effort to replace any of her furniture and clothing that were lost in the SGRV fire.


It is interesting to disclosed that after the fire in Ms. Weinkauf-Donovan apartment that SGRV moved her to the SGRV apartment #1027. Ms. Weinkauf-Donovan, her daughter Tonia Chambers, and Glenn Chambers used the SGRV apartment #1027 for several weeks while they relocated Ms. Weinkauf-Donovan to a real assisted living home. Ms. Chambers has told me that the SGRV #1027 smelled and they are all sick from what ever was in the apartment. I informed Ms. Chambers that the SGRV apartment #1027 was Carol's, my wife,  former apartment. I had the SGRV apartment #1027 tested for toxic mold in October, 2009. The mold report showed that the SGRV apartment #1027 was full of TOXIC BLACK MOLD.

That was the SGRV apartment #1027 that started Carol's transplanted liver rejection and killed our three dogs due to liver cancer. SGRV told Ms. Chambers that SGRV never had Toxic Mold which is simply more lies.
 
A PLACE FOR MOM and SGRV made a lot of money scamming Ms. Weinkauf-Donovan. Ms. Chambers just got a bill from SGRV.
 
The SGRV owners are:
 
1.  NOT taking any responsibility for the SGRV fire,
2.  NOT replacing Ms. Weinkauf-Donovan's  destroyed belongings,
3.  IGNORING their false advertising crimes,
4.  COULD CARELESS that Ms. Weinkauf-Donovan's family is very ill from the  SGRV TOXIC MOLD EXPOSURE.

Arizona Lawmakers Failed to Pass the Unlicensed Assisted Living Facility Law - Seniors are at RISK!

IT IS TIME FOR A CHANGE IN
ARIZONA’S LEADERSHIP
 
The Arizona Lawmakers that were elected to represent the Sun Cities Areas are not making Elder Abuse Prevention a priority.

Rep. Debbie Lesko wants to pull monies from the financially strapped public school systems to pay for private schools. Rep. Rick Gray wants his legislative term expanded from two years to four years. Rep. Phil Lovas wants the usage of unapproved drugs for the terminally ill. Not one of the six lawmakers in our senior retirement area (Murphy, Burgess, Gray, Lesko, Lovas, and Livingston) have expressed any interest or introduced any new legislation of our purposed senior protection laws.

We have introduced bills that would make stronger laws against Elder Abuse and Fraud for three previous sessions with no success. The current session we have introduced the following purposed laws, which would:  make elder abuse a felony hate crime law, require caregiver background checks, give greater authority to the Department of Health Services to regulate senior living imposters, allow triple damage awards for senior frauds, and impose penalties for authorities who fail to protect the elderly and vulnerable.

But no one is listening.

Arizona is in trouble with: unemployment 1% higher than the national average, extremely excessive high school dropout rates with one out of four students failing to graduate, the worst child hunger rate in the United States with one out of four children not receiving adequate food, the third worst state in education funding which leads to students being shortchanged and failing to graduate from college; and failing to properly protect the vulnerable.

The Sun City Areas lawmakers are failing to represent their elder constituents from elder abuse and fraud with stronger senior protection laws.

Arizona is in trouble. It time to elect new lawmakers that don’t just care about their own “pet projects,” but to “properly serve” their constituents and the Arizona public.

COMMENTS: It was three years ago on 02/14/11 that Carol and I presented the Unlicensed Assisted Living Facility (UALF) Law to the Arizona House Ways and Means Committee. The Arizona Department of Health Services appeared with us and wanted this loophole closing law to protect seniors from dangerous impostor senior living facilities. The needed UALF law was ignored and the false advertising crimes at Sun Grove Resort Village (SGRV) continues to exist unregulated. 
 
The 72-year old senior Joanne Weinkauf-Donavan was just duped by A PLACE FOR MOM when she was told SGRV was a licensed assisted living facility but that was a lie. Ms. Weinkauf-Donavan has just moved into a real licensed assisted living facility because of her health needs. Ms. Weinkauf-Donavan had a fire in her SGRV apartment and lost everything. She nearly died but the Arizona Press ignored the very sad story and all the illegal activities at SGRV, such as an impostor nurse.
 
 
The Arizona Senior Housing Guided PACE is the bible in the senior housing industry and is available in churches and libraries. SGRV still falsely advertises in PACE that it is an assisted living facility.
 
The state lawmakers have done nothing in the past four years to stop this scam against the elderly.
