TOXIC MOLD PROBLEMS AT SGRV

Sun Grove Resort Village (SGRV) is a senior living facility located at 10134 W. Mohawk Ln., Peoria, AZ 85382. SGRV was built nearly 30 years ago. SGRV consists of 11 buildings which house 86 separate apartments and a main club house/office/dining room.  In May, 2006 the former 20 SGRV owners purchased the property for $4.1 million as an investment from the Oakdale Heights/AREI Ponzi Scam. The SGRV owners took possession of the property in 2008 when the Ponzi Scam collapsed. They had to put an additional $400,000 in order to keep the senior living facility in operation until they could sell it after the recession. The SGRV was poorly maintained and the seniors moved out of the distressed and dangerous senior living facility. The property never could be sold. The bank repossessed the senior living property this year and is now trying to sell this “slum property.”

The SGRV property has extensive mold problems plus poor and dangerous living conditions of: bad electrical wiring, dilapidated buildings, poor kitchen conditions, obstructed walkways, a cockroach and bug problem, and poorly maintained landscaping. The Sun Grove Resort Village (SGRV) mold and property problems are extreme health hazards to the residents and the public. The SGRV residents need to be evacuated and the SGRV buildings need to be destroyed.

The Maricopa County Environmental Services was called out for a mosquito infestation complaint on 05/20/2011. The inspector found mold in the front SGRV fountain that was causing the mosquito problem.  This mold in the front fountain was found again by the Maricopa County Environmental Services on another mosquito infestation complaint on 06/20/2014.

at SGRV which can kill people .

The Advanced Mold Inspections Com states:  “BIOPLARIS: A widespread fungus that is most frequently associated was grasses, plant material, decaying food, and soil. It is common to both indoor and outdoor environments. Older obsolete names include Dreschslera and Helminthosporium. This fungus produces large spores which would be expected to be deposited in the upper respiratory tract. Various species of this fungus can produce mycotoxin – sterigamatocystin which has been shown to produce liver and kidney damage when ingested by laboratory animals.   DRESCHLERA: Conidia (spores) dimension 40-120 x 17-28 microns. Found on grasses, grains and decaying food. It can occasionally cause a corneal infection of the eye.”
We have testimony from the following people that SGRV had a mold problem, they are:

1.   07/29/11 – John Eggen - son of former SGRV resident Lil Eggen, found mold in his mother’s apartment.
2.   11/15/12 – DeDe Stockton - former SGRV Concierge for one year saw mold in SGRV apartments.
3.  11/24/12 – Fredda Sharp-former SGRV Activities Director for 5 years saw mold in SGRV apartments.

Fredda Sharp was told by SGRV’s manager and 2005 Medicare Fraud Felon, Scott Green, to keep the mold problem quiet. SGRV's Executive Director, Scott Green, was terminated on 08/28/12 when it was discovered that he pled guilty to stealing $70,000 in nearly 2,700 bogus Medicare Claims in 2005.
 
NEW SGRV TOXIC MOLD DISCOVERY
 

Recently, toxic mold was found in the SGRV men's bathroom during the repair of a plumbing leak this year. The picture of the SGRV toxic mold leak was provided by the former SGRV Sales Manager, Lucy Huerta. The toxic mold was not properly cleaned up which puts all the elderly residents living at SGRV at extreme risk in the main building and in the dining room.
 
Toxic Mold was found in the men's bathroom this year, which is located in SGRV's main building near the dining room.

SGRV’s attorney, Scott E. Williams, hired a very small inspection company, ENVIRONMENT CONSULTING, INC. (ECI), to inspect our SGRV apartment for mold.  The Arizona Corporation Commission records show ECI was incorporated in September, 2008 and did business out of Miranda Mayo’s (the owner) house.  ECI’s Brandon White did the mold test at our SGRV apartment on 10/16/09. He falsely stated that he found no mold in his 10/20/09 ECI mold report.

This mold report was simply a phony mold report that was produced by attorney Scott E. Williams to disprove our nationally known mold inspection company, Pro-Lab. SSPTM, Inc.’s, positive mold results. ECI was out of business on 02/03/11 because the Arizona Corporation Commission closed the company for nonpayment of their annual dues.  ECI closed BEFORE HUD’s Catherine Ross-Perry verified the authenticity of the ECI mold report on 05/03/11. Also, ECI used the mold lab, Tierra Science, which had been closed due to inaccurate tests. The ECI mold report has no credibility because it was free, the ECI inspector Brandon White went to work for Scott E. Williams, ECI and Tierra Science Lab were closed, and the inspector Brandon White lied to HUD and the Arrowhead Justice Court. HUD failed to discover that the ECI mold report was phony documentation generated by SGRV’s Felon, Scott Green, and SGRV’s attorney, Scott E. Williams.

ECI was underfunded since Arizona had to close the little over two-year business for the nonpayment of its state fees.   ECI’s Brandon White reported in his 05/03/11 HUD interview that he gave SGRV a $300 discount because he was late generating the report. That was a lie because the report was completed, sent by email, and mailed by Certified Mail on 10/20/09, which is only four days after the test was done and not the seven days he reported to HUD. Brandon White lied because on 10/22/09 he waived the entire $427.23 ECI mold report fees for SGRV.
Finally, Brandon White lied to HUD stating he had no business relationship with Scott E. Williams. Brandon White was hired by Scott E. Williams to be the mold consultant for Williams’ lawyer group, the ASSOCIATION OF LANDLORD TENANT ATTORNEYS (ALTA). On 05/06/2011, Brandon White spoke before ALTA, which was only three days after his perjurous HUD testimony.
Brandon White benefited by producing a free false mold report because he was hired by Scott E. Williams’ ALTA group of 20 attorneys after ECI had closed. According to the Arizona Corporation records Brandon White started his own company, Enviroscience Consulting, Inc. According to the Arizona Corporation Commission records Brandon White started his company on 07/14/11, which is only a little over two months after he had lied to HUD. We suspect Scott E. Williams enabled Brandon White to start his own company. We suspect that was done to hide the fact that SGRV was and is full of mold, and it is a very dangerous and deadly property.

When we lived at SGRV with our service dog, Wheeler, who got deathly sick from the toxic mold.  We had to move because the leaky moldy SGRV apartment was not safe for us. SGRV’s felon manager, Scott Green, and SGRV’s attorney, Scott E. Williams refused to remove the mold in our apartment and refused to let us move to a mold-free apartment. They used their falsified mold report stating there was no mold but that was untrue.

post-liver transplant patient and that SGRV toxic mold exposure started the rejection of her transplanted liver. Our dogs, Wheeler, Bridget, and Brittany, all died of liver cancer. We have spent all our monies in hospital fees and doctor bills in an effort to keep Carol alive. We have been denied any justice for the violations of our Fair Housing Rights by HUD and the Arizona Attorney General.
SGRV's attorney, Scott E. William, sued us twice for the $3,500 bill that we refused to pay because our civil housing rights were violated by SGRV. These law suits were filed in the same Arrowhead Justice Court at different times. We lost because the court refused our evidence and refused to delay the trial because our witness was in a coma in the hospital. We have over $23,000 in judgments (over $10,000 of that is in attorney's fees). Our second inept judge Melanie Deforest was later forced to resign because she had lied about her qualifications and the lack of a college degree. Our Fraud of the Court Motion and our Appeal to this gross injustice have been denied.
It helps that Scott E. Williams was hired in 2004 by the Maricopa County Board of Supervisors to represent all elected officials of Maricopa County on election matters and he also handles the evictions on all the Maricopa County rentals. Scott E. Williams is the "Evictions King" in Arizona with over 100,000 evictions in 20 years because he is "PROTECTED." It comes as no surprise that the tape and our evidence in the second July 8, 2009 kangaroo trial have been lost or destroyed.
Arizona has no laws concerning toxic mold for homeowners, business property owners, and apartment renters (only for schools). Renters are unable to break their leases even if their lives are in jeopardy because of dangerous conditions. Arizona is a "Slumlord's Paradise" because Scott E. Williams wrote the Landlord/Tenant Act which gives renters no rights. Scott E. Williams is cashing in on the victims of slumlords and Arizona allows his criminal, immoral,  and unethical activities!

Dangerous living conditions are being allowed to exist at a senior living facility in Peoria, Arizona. This property was recently repossessed in 2014 by Bank of America because the former owners filed for bankruptcy. This property was a part of the Oakdale Heights/AREI Ponzi Scam that defrauded 2,000 investors of $250 million in California largest real estate Ponzi scam. Twenty three senior living facilities were destroyed by the Ponzi scam which hurt 2,500 seniors living in those facilities. The mastermind of the Ponzi Scam, James Koenig, was sentenced in 2013 to 43 years in prison because of the money scam and elder abuse.
 
 
Sun Grove Resort Village (SGRV) was one of those properties involved in the Ponzi Scam. The 20 owners were originally investors in the Ponzi Scam but took ownership of the senior living property after the Ponzi Scam collapsed in 2008. The SGRV owners allowed property to deterate and failed to maintain the property because they lost $4.5 million on their original investment. The intent was to sell the property which never happened. The senior living property is nearly empty because of the bad and dangerous property conditions.
 
The living conditions continue to deteriorate at SGRV as documented with the recent Kitchen and Dining Room Inspections.
 
 
 
KITCHEN INSPECTION
08/28/2014
 
 
Sun Grove Resort Village (SGRV) is presently being operated by a bank property management company after being repossessed by the bank. Fannie Mae pulled the senior living facility from an auction due to the poor property conditions (bad electrical wiring, dilapidated buildings, uneven walkways, bug infestation, and toxic mold). The senior living facility is up for sale. The poor living conditions at SGRV are highlighted by the recent Maricopa County Environmental Services inspection of the kitchen.
 
The 08/28/2014 inspection revoked the permit for the restaurant but allowed the SGRV eating area to remain in operation for a month in order to fix the following problems:
 
1.  Broken chemical dispensers,
2.  Drain lines under sink held together by duck tape,
3.  Hot water supply to sink is broken,
4.  Piping under sink not using proper materials,
5.  Steamer under hood is broken,
6.  Hand washing sink broken,
7.  Refrigerator/freezer not a proper commercial unit but is meant for home usage,
8.  Laminate counters are in disrepair,
9.  Beverage/coffee station is in poor condition and not easily cleanable.
 
The reported stated County legal action may result from this inspection.
 
 
KITCHEN INSPECTION
09/30/2014
 

 
The second inspection on 09/30/2014 showed enough improvement to issue a restaurant permit which allows the senior living facility's kitchen to continue to operate. However, not all problem issues were repaired. The County has allowed the senior living facility to continue to try to find a buyer in order to finish repairing the kitchen and dining room problems.
 
The SGRV property manager, Michael Mednansky, stated that the plan is renovate the dining room by the next owner. It appears a 90-day time limit for the change of ownership or final resolution to the kitchen and dining room problems at SGRV was set. The last inspection states that SGRV is continuing to face legal actions from the Maricopa Environmental Services.  
 
SUMMARY
 
Just because the bank's management company is running this bad and dangerous senior living facility the County should require all the kitchen and dining room problems and dangers to be immediately repaired. The County is allowing SGRV to continue to operate the dinning room until the end of November, 2014 which continues to put the few seniors that live there and the public that eats there at risk. The Maricopa County Restaurant Inspectors have set a 90-day time limit from the first inspection so on 11/28/2014 if the property is not sold or the kitchen and dining room problems are not totally repaired then the restaurant permit is revoked, the kitchen is closed, and legal actions will take place.   
 
It is anticipated that this poorly maintained and dilapidated senior living facility will close the end of November, 2014 because it will never find a buyer. It is believed the bank will eventually cut its losses by closing SGRV and destroying this very dangerous and dilapidated senior living facility.

The SGRV is on borrowed time until November 28, 2014 to have the kitchen and dinning room stay open because of the continued deteriorating and dangerous eating conditions there. SGRV needs to be immediately closed and the buildings need to be destroyed in order to protect the elderly residents and public from the HAZARDS and RISKS caused by this dangerous senior living facility.

Robert Freund filed a Baseless "Junk" Lawsuit against us on December 12, 2013, for $3,800.00 plus legal fees after making three prior different amount monetary demands.
 
We paid Mr. Freund nearly $14,000 to repair an under-slab kitchen water leak and rebuild the kitchen cabinets. We discovered over 60 problems of poor workmanship and intentional contractor sabotage (a crimped waterline). After our Beach of Contract email, we also experience two telephone threats of violence from Robert Freund's employee, Derrick King, plus he refused to return our house key and alarm fob unless he was paid $7,000.00 cash. A Police Report was filed on August 08, 2013. This contractor contract dispute escalated in more criminal activities. Injunctions Against Harassment were granted against Robert Freund and Derrick King.
 
The Court has denied all Motions to Dismiss this Baseless Lawsuit. The Court ignores the Rules of Law for the filing of the Plaintiff's Pleading within the proper time schedules.  Robert Freund misuses the Court as a collection agency to harass and defraud the elderly for payment of unearned monies.
 
Our Public Adjuster failed to follow the contract we signed and closed out the claim without a "final walk-though" and without our approval. Our Public Adjuster showed favoritism to Robert Freund because they were working on a claim on his house and he refers many clients to them. Our Public Adjuster canceled our contract and all debts to them. Our Public Adjuster cost us thousands of dollars in hotel fees and repair costs.

ARIZONA OFFICIAL'S ENABLE BAD CONTRACTOR, ROBERT FREUND, TO ABUSE AND DEFRAUD THE ELDERLY

We have suffered telephone threats, attempted extortion, a baseless lawsuit, intentional criminal sabotage (a crimped waterline), and criminal damages to our property (cut electrical lines to sprinkler system, disabled motion detector lights, and attempted murder with the nailing and slashing of all of our four car tires) after we fired the contractor Robert Freund for Breach of Contract on August 08, 2013.
 
Judge Gerald Williams approved Injunctions against Harassments against Robert Freund (owner of the contractor companies) and his employee Derrick King on May 09, 2014. Judge Williams said the criminal activities against us "went to pattern" after Derrick King, who has a violent criminal record, threatened us twice on the phone on August 08, 2013, demanding $7,000 cash and refusing to return our house keys and alarm fob. Mr. King stated he would do anything to collect the remaining balance and that we did not want to know the severity of  his threats. This attack happened even after Freund's contractor companies were paid $13,700.14 for delayed substandard home repairs that did not meet building codes. Three Police Reports have been filed in the past year for telephone threats and criminal damages.

Our losses are:
 
1. $30,000 for the repair of the substandard home repair work,
 
2. $10,000 for a security camera system/payment of security guards/lawsuit expenses/medical bills,
 
3. $20,000 for the 10% loss of value to our house because the mold was not properly removed, and
 
4. Damages to our health because this stress caused my wife, Carol, to have a stroke and I am having increased seizures.
 
Arizona Officials Do Nothing
 
We filed Complaints #2014-250 and #2014-251 against Robert Freund's plumbing company and home repair company on January 17, 2014 with the Arizona Registrar of Contractors (ROC) listing with pictures of over 60 incidents of poor workmanship and sabotage. Our ROC Inspector, Stephen Lawton, barred Robert Freund from our home because of the threats and criminal damages. The Police told us we had the right to protect ourselves and not allow the bad/dangerous contractor into our home because we feared for our lives with the Arizona Castle Law.
 
 
It took five and a half months to receive the ROC's dismissal of our complaints on June 30, 2014, because we failed to allow the contractor his rights to inspect our home and repair the problems. This was very odd because the contractor had no rights because at the time of our home repair his plumbing licensed had expired and was not renewed plus he had no required Qualified Party (a state approve licensed contractor) for his home repair company. Robert Freund was operating as an Unlicensed Contractor the whole time of our home repair job, May 28, 2013 to August 08, 2013, and had no contractor legal rights.
 
 
The ROC is being run by William Mundell, a former state lawmaker, who is allowing the Arizona Legislature to drain the Contractor Recovery Fund since he was appointed by Governor Brewer in 2009. The 2013 audit by the Arizona State Auditor, Debbie Davenport, stated that the ROC is failing because of: the slowness of complaint processing, the wrongfully closing complaints, the poor follow through on required contractor home repairs, no verification that required contractor payments to the homeowners were ever made, the failure to escalate discipline against repeat contractor violators, and that homeowners are not getting the relief they are entitled by law from the Contractor Recovery Fund that has insufficient funds to pay the approved claims.

The ROC failed us by failing to timely update its website concerning the problems of Robert Freund's contracting companies' licenses. The ROC failed us by wrongfully closing our contractor complaints on Robert Freund's Unlicensed Contractor Companies.

 
 
The ROC declined us the day before the ROC's policy change to eliminate the "15-day Window for Corrective Complaints" which allowed the contractor to repair the their problems. On July 01, 2014, the ROC went to a "Directive System" which posts all contractor poor workmanship issues publically for two years in order to warn Arizonans about bad contractors.

This is critical to us because Robert Freund failed to contain the mold removal, exposed and contaminated our entire house to mold, and failed to obtain the required Mold Removal Certificate from the mold specialist as required by law. That is probably because Robert Freund does not pay his subcontractors because we received many desperate calls for help from them.

All emails, letters, and phone calls have been ignored by ROC's William Mundell, ROC's Stephen Lawton, and Governor Brewer.
 
We filed a complaint #14-01841 with the Arizona Attorney General Tom Horne on February 10, 2014,  listing five laws Robert Freund is breaking. Tom Horne has done nothing.

Our ignored letter dated July 14, 2014, to Governor Brewer lists five state laws and six contractor law violations that calls for the IMMEDIATE REVOCATION of all Robert Freund's contractor licenses. That letter and information was posted to the Internet on July 25, 2014, as: "Arizona Registrar of Contractors is Failing Arizona Homeowners."

Homeowner Associations in the Sun Cities
are taking Action
 
Both the Homeowners Associations in the Sun Cities Area, SCHOA and PORA, no longer recommend Robert Freund's plumbing company and home repair company for the past several years because they have received too many complaints due to poor workmanship. The ROC has many complaints filed and being filed against Palmer's Kitchen, Bath and, Beyond LLC and Palmer's Plumbing dba Ben Franklin Plumbing.
 
 
Sadly, the Arizona Officials are enabling this bad and dangerous contractor, Robert Freund, to continue to abuse and defraud the elderly by not stopping his criminal activities.
