MARICOPA COUNTY JUSTICE OF THE PEACE COURTS FAIL TO FOLLOW THE RULES OF LAW AND ARE SIMPLY A BILL COLLECTOR FOR ARIZONA CROOKS

Sun Grove Resort Village (SGRV) was one of 23 senior living facilities used in the AREI/Oakdale Heights Ponzi Scheme which defrauded 2,000 investors of $250 million and hurt 2,500 seniors living the the senior living facilities that had to close. The 20 SGRV investors lost $4.5 million on their SGRV Ponzi Scheme Investment collateral that they ran into the ground for six years. SGRV was managed by the 2005 Medicare Fraud Felon, Scott Green, and the Arizona Law Enforcement never properly investigated the SGRV elder abuse and fraud claims plus they never discovered Green's background of scamming seniors (Green was terminated August 2012).

SGRV's attorney, Scott E. Williams, filed many baseless lawsuits because the seniors moved because of the false SGRV advertising (it was not a licensed assisted living facility with a nurse on duty). SGRV has just filed bankruptcy and was foreclosed upon by the bank. SGRV went up for an auction last week and the property is a dangerously dilapidated property that is full of toxic mold.

Judge Melanie Deforest was forced to resign from being a Justice Court Judge because she lied about her academic and work background. The Arrowhead Justice of the Peace Court has lost or destroyed our evidence and the tape of our 2010 kangaroo trial. 

We posted the SUN GROVE RESORT VILLAGE ELDER ABUSE STORY online per the request of the US SENATE - Special Committee on Aging. The report included 66 SGRV elder abuse/fraud stories and 36 the those seniors have died without any justice in the Arizona Badlands.

NEWS: We just confirmed with the attorney that the Sun Grove Resort Village property auction, located at 10134 W. Mohawk Ln. Peoria, AZ 85382, had no acceptable bidders on 06/13/2014 and the property reverted back to Fannie Mae. It appears this property is too dangerous to buy and hopefully it is destroyed to protect the public.

SGRV's Guilty Parties of Elder Abuse and Senior Financial Exploitation are: Scott Green (2005 Medicare Fraud Felon), Karl Nunley, Carolyn Duncan, Seniority, Inc. (the former Management Company of SGRV), and attorney Scott E. Williams.


The picture is taken at the 10/2009 Seniority, Inc., Awards Conference in Las Vegas where Scott Green received the Manager of the Year when he was busy abusing and defrauding SGRV seniors. SGRV's scam was: false advertising (SGRV is not a licensed assisted living facility as advertised and therefore was not policed by the state assisted-living inspectors), impostor nurse (Claudia Marquez is not a licensed nurse and was previous cited for illegally representing herself as a nurse in 2005 but still does nursing duties and wrongly portrays herself as a nurse), and baseless lawsuits (SGRV's attorney, Scott E. Williams, misused the court system to raise operating funds for SGRV).

I just called you and talked to John in the News Room. In 2013 you did three stories about victims of a senior living facility Sun Grove Resort Village (SGRV) located at 10134 W. Mohawk Ln Peoria 85382. The stories were about Clay Hanning, Ann Graham, and us, Mark and Carol Fairall.

Since your story the manager, Scott Green, was found to be a 2005 Medicare Fraud Felon and was fired in August 2012.

The SGRV Company has just filed for bankruptcy and the property was repossessed by the bank. The 86 unit apartment house is being auctioned June 13th but the problem is that it is full of mold. This auction can be verified by public record filed with Maricopa County Records or call the bank’s attorney handling the auction Quarles & Brady LLC at (602) 229-5200.

This is an excerpt from our report filed online called THE SUN GROVE RESORT VILLAGE ELDER ABUSE STORY that was sent to state and federal officials.

SGRV Report

Sun Grove Resort Village (SGRV) is a senior living facility located at 10134 W. Mohawk Ln., Peoria, AZ 85382. SGRV was built nearly 30 years ago. SGRV consists of 11 buildings which house 86 separate apartments and a main club house/office/dining room.  In May, 2006, the present 20 SGRV owners purchased the property for $4.1 million as an investment from the Oakdale Heights/AREI Ponzi Scam. The SGRV owners had to put an additional $400,000 in capital into their bad SGRV investment in order to keep the senior living facility in operation until they could sell it after the recession.
                                                                                                 
The SGRV property has many problems because it has been poorly maintained for over six years. The SGRV property has extensive mold problems and dangerous living conditions (bad electrical wiring, obstructed walkways, no emergency alarm system, broken emergency elevator phones, and no fire drills). This has been documented by Maricopa County Environmental Services, Arizona State Board of Cosmetology, Pro-Lab/SSPTM, Inc., and notarized/written statements.

MOLD PROBLEMS:

The Maricopa County Environmental Services was called out for a mosquito infestation complaint #310225 on 05/20/11. The inspector found mold in the front SGRV fountain that was causing the mosquito problem.  Our Pro-Lab. SSPTM Inc. apartment mold study kit found unacceptable levels of the molds Bipolaris and Drechslera in our SGRV apartment on 10/18/09.
                                                                                                                                  
The Advanced Mold Inspections Com states:  “BIOPLARIS: A widespread fungus that is most frequently associated was grasses, plant material, decaying food, and soil. It is common to both indoor and outdoor environments. Older obsolete names include Dreschslera and Helminthosporium. This fungus produces large spores which would be expected to be deposited in the upper respiratory tract. Various species of this fungus can produce mycotoxin – sterigamatocystin which has been shown to produce liver and kidney damage when ingested by laboratory animals.   DRESCHLERA: Conidia (spores) dimension 40-120 x 17-28 microns. Found on grasses, grains and decaying food. It can occasionally cause a corneal infection of the eye.”

We have testimony from the following people that SGRV had a mold problem, they are:

1.   07/29/11 – John Eggen - son of former SGRV resident Lil Eggen, found mold in his mother’s apartment.
2.   11/15/12 – DeDe Stockton - former SGRV Concierge for one year saw mold in SGRV apartments.
3.  11/24/12 – Fredda Sharp-former SGRV Activities Director for 5 years saw mold in SGRV apartments.

The SGRV mold and property problems are extreme health hazards to the residents and the public. The SGRV residents need to be evacuated and the SGRV buildings need to be destroyed. Presently SGRV is being managed by the Bank’s trustee, Grace Management, and there is massive layoffs taking placing while many seniors are being forced to move.

Note: we now have recent testimony from the former SGRV marketing director, Lucy Hureta, who verified the toxic mold now is in the SGRV men’s room in the main club house.

You seem to be the only local news media that really reports important news and this should be reported to protect the public.

Sun Grove Resort Village is a dangerously dilapidated property that has been poorly maintained for six years and it is full of toxic mold and has bad electrical wiring. The property should not be auctioned on June 13, 2014 but it should be condemned and destroyed to protect the public.

Mark and Carol Fairall - Elder Justice Advocates


 
Mark was forced in retirement from his bank manager career, at 43, because of a stroke. Carol ended her restaurant management career, at 57, because of a needed liver transplant. After we retired we met at our senior living facility, Sun Grove Resort Village (SGRV). We saw the abuse and corruption there and we fought for the rights of our fellow senior residents. Our fight against elder abuse and senior financial exploitation has mushroomed into our being Elder Justice Advocates. The US Senate – Special Committee on Aging had us post our story about the SGRV elder abuse story and about the SGRV 66 elder abuse cases, 36 seniors have died with no justice. SGRV’s problems started with being involved in a Ponzi scheme and the 20 out-of-state owners who lost $4.5 million on their SGRV investment.

We reported the SGRV Elder Abuse and Financial Exploitation Crimes to the Peoria Police and the Arizona Attorney General. However, the Arizona Law Enforcement failed to interview the SGRV abused victims and failed to discover that the manager of SGRV, Scott Green, was a confessed 2005 Medicare Fraud Felon that made his living scamming the elderly and government. Scott Green was terminated on 08/28/12 but the SGRV crimes of false advertising, baseless lawsuits, and imposter nurse continues today. We presented our documentation to the California Court concerning the mastermind of the Oakdale Heights/AREI Ponzi scheme, James Koenig. That Ponzi scheme defrauded 2,000 investors of $250 million and hurt over 2,500 seniors that were living in the 23 senior living centers destroyed in the Ponzi scheme. Based upon our evidence the judge recently sentenced James Koenig to 43 years in jail. The California judge said this was more than the money but it was elder abuse.

We speak from experience after being abused and seeing many seniors abused and financially exploited. We teach classes and write articles as THE REAL FACES OF ELDER ABUSE. Our emphasis is on how to avoid being a victim of elder abuse and fraud. Elder Abuse and Senior Fraud has become epidemic and the CRIME OF THE 21ST CENTURY with a senior being abused in the US every five seconds. We teach that the key to stopping elder abuse is to prevent it before it happens with knowledge. We write a daily Facebook “Mark Fairall” sharing elder abuse stories, new senior protection law ideas, and tips on senior scams. Finally, we present new senior protection law ideas to our state and federal lawmakers.

 
Mark has been recognized in 2013 by COVINGTON’S WHO’S WHO for his civic volunteer activities. Carol was the runner-up for ARIZONA AARP’S 2013 Andrus Community Service Award. Carol recently received and letters from President Obama and the US Department of Health and Human Services thanking her for her volunteer work and wishing her better health.

APRIL IS NATIONAL DONATE LIFE MONTH
 
National Donate Life Month (NDLM) was instituted in 2003 and is celebrated every April. The NDLM has many state and national activities in April to register organ donors that can give the “GIFT OF LIFE.” The Donate Life Flag is flown in April over hospitals, transplant centers, and all recovery agencies in order to make a visible and unified statement about the importance of organ donations and to show the dire need for organ donors.
 
On March 31, 2014 President Barack Obama issued the Presidential Proclamation stating: “I call upon health care professionals, volunteers, educators, government agencies. Faith-based and community groups, and private organizations to join forces to boost the number of organ and tissue donors throughout our Nation.”  President Obama also stated that more than 120,000 Americans are on the transplant list but 18 of them die every day waiting. Every donor can save eight lives thanks to scientific advances. Lastly, the President urged the Public visit www.organdonor.gov or sign up in your State’s donor registry. The President stated: “As a Nation, let us shine a light on the power of donation. Let us lift up the friends and families of donors and remember those who ensured that in their death, others received life.”
 
Some organ donation facts from DONATE LIFE AMERICA are:
 
1.  An average of 79 organ transplants take place every day in the United States
2.  Over 46,000 patients had their sight restored last year through corneal transplants.
3.  A living donor can provide a kidney or a portion of their liver, lung, pancreas or intestine.
4.  More than a million tissue transplants are performed every year and the need is rising.
5.  As of June 2013, over 112 million people (46%) of the US adult population are registered as organ donors.
6. Every major religion in the United States supports organ donations as the highest expression of generosity and compassion.
7.  There is no cost to the donor’s family or estate for organ donations.

Recent statistics from the USA TODAY show that Arizona is ranked the third lowest organ donor state in the nation at 17.2%.  The top organ donors’ states are: Colorado – 64.4%, Iowa – 62.8%, Montana 62.4%, Washington – 56.7%, and Wyoming – 55.4%. The worst organ donors’ states are:  New York – 11.1%, Michigan – 12.7%, Arizona – 17.2%, California – 25.5%, and Kentucky – 25.9%. It is difficult to get an organ transplant in Arizona because the supply of organs are so low.
 
Last year we attended the DONATE LIFE EVENT at the Arizona State Capitol. We had the honor to meet the “THANKSGIVING MOM” and listened to her story of love. Her only daughter had died in an automobile accident and her organs were used to save the lives of six people. Those six transplant recipients celebrate Thanksgiving with her every year honoring her daughter for giving them the “Gift of Life.” The Thanksgiving mom stated that she knows her daughter is in Heaven but she is so blessed because she feels her presence every Thanksgiving when the people her daughter saved celebrate the holiday together.
 
Organ donation is a subject near and dear to our hearts since Carol received her transplanted liver in October, 2007 at Banner Good Samaritan Hospital. Carol is very active mentoring organ donors and raising awareness and funds for this worthwhile cause. We urge all Arizonans’ to mark the Organ Donor box on their Driver’s License and share life.

Service Dog Laws Are Not Enforced

NOT ENFORCED

I was illegally charged a “Pet Deposit Fee” in a senior living facility but no one enforces the Service Dog Laws. I was denied my federal and state disabled civil rights. It is against the law to deny access or to charge for a service dog by a landlord.

WHEELER'S MEDICAL SERVICE DOG ID
I was charged $450 for my licensed and trained service dog that assisted me when I had seizures. The Peoria Police, the Arizona Attorney General, and the Department of Housing and Urban Affairs (San Francisco HUD) refused to enforce the service dog laws. Also, the Maricopa County Justice Court denied my claim to recover the illegally charged service dog’s $450 pet deposit fee.

Now, I attempted to rent a condo in Sedona for the summer but I was turned down because I have a licensed and trained service dog. The Sedona landlord told me that no one enforces the service dog laws. Sadly, the Sedona landlord is right.

I just happened to be looking for a companion since my mother had just died. The breeder was recommended by a neighbor and I went to her Sun City house in March, 2003. The breeder had me sit in the middle of the room to see which of her ten dogs took an interest in me.  Wheeler ran to me and jumped into my lap and picked me for his forever buddy.  I had to write a letter saying how I was going to treat Wheeler. The Breeder allowed me to adopt Wheeler. Wheeler always had two birthdays a year, his birthday and his adoption day.

We spent four years together living alone and having fun in my house.  Since I have seizures, Wheeler became trained to be my Service dog.  He pushed the emergency alarm button three different times saving my life.  When we moved to a senior living facility, Wheeler spotted my future wife, Carol.  Wheeler had always been very reserved, but that was not the case with Carol.  Wheeler acted as our honorary Best Man at our wedding.
When we lived at Sun Grove Resort Village (SGRV) Wheeler got deathly sick from the toxic mold.  I just gave our lawyer our 10/23/09 letter to SGRV stating that we had to move because the leaky moldy apartment was not safe for us. Carol, a post-liver transplant patient, Wheeler, Bridget, and Brittany, and I were all getting very sick from the toxic mold at SGRV.  Wheeler passed away last September just like Carol’s two Yorkies, and they all died of liver cancer.  The picture is of Wheeler the night before he died celebrating his birthday early before his Heavenly Birthday.

Bridget and Brittany passed from liver cancer after being exposed to the SGRV toxic mold shortly after we moved to our home. All three of our dogs that SGRV killed are buried in our backyard with little crosses on their graves. 

Our hearts ache from their deaths as we view their little graves daily.
